In a landmark decision, the Supreme Court of India, comprising Hon’ble Justice Pamidighantam Sri Narasimha and Hon’ble Justice Manoj Misra, upheld the rights of students with disabilities in Civil Appeal No. 68/2025. The case arose from Kendriya Vidyalaya Sangathan’s (KVS) failure to follow CBSE guidelines, which led to a violation of the petitioner’s rights under the Rights of Persons with Disabilities Act, 2016.
The petitioner, a Class IX student with disabilities, was denied necessary accommodations such as a scribe and compensatory time, outlined in CBSE’s Standard Operating Procedures (SOP) for students with benchmark disabilities. This negligence resulted in the student’s inability to clear examinations.
The Court directed CBSE to ensure all necessary facilities and exemptions as per the SOP are provided for the petitioner to retake the Class IX examination in 2025. KVS’s non-compliance with CBSE regulations highlights the urgent need for adherence to inclusive education policies.
