SRINAGAR, Nov 12: The Jammu and Kashmir Police Headquarters has ordered the attachment of the residential property belonging to former President of the Jammu and Kashmir High Court Bar Association, Mian Abdul Qayoom, under provisions of the Unlawful Activities (Prevention) Act (UAPA).
According to Order No. 4340 of 2025, issued from the office of the Director General of Police, Jammu and Kashmir, and signed by DG Nalin Prabhat on November 12, the action follows an investigation into an old case registered at Police Station Shaheed Gunj in FIR No. 157/2009 under Sections 120, 120-B, 121, 153-A of the RPC and Sections 13, 38, and 39 of the UAPA.
The case dates back to December 31, 2009, when the Shaheed Gunj Police Station reportedly received credible inputs about a seminar organized by separatist leaders on the death anniversary of Late Ali Mohammad Jinnah at Hotel Jahangir in Srinagar. The event was allegedly organized by Feroz Ahmad Khan, then vice-chairman of the Muslim League, and attended by several prominent separatist figures, including Aasia Andrabi, Shabir Ahmad Najar (District President Muslim League), and Mian Abdul Qayoom.
The order states that the participants in the seminar delivered anti-national speeches, raised slogans against the integrity of India, and advocated for the secession of Jammu and Kashmir, emphasizing that “the future of Kashmir depends upon Pakistan” and calling for the imposition of Islamic law in J&K.
During the investigation, witness statements reportedly confirmed that the seminar’s participants had incited the crowd through inflammatory speeches, urging support for the separation of J&K from India. Based on this evidence, several accused persons, including Mian Abdul Qayoom, were found involved in the commission of offences under the cited laws.
The order further reveals that a house search was conducted at the residence of Mian Abdul Qayoom after obtaining a search warrant from the competent court. During the search, the police claim to have recovered incriminatory material, including banned literature, a blank letterhead of Hizbul Mujahideen with a seal impression, a press note purportedly issued by the banned militant organization, and a letter from Syed Salahuddin addressed to then U.S. President Bill Clinton. Additionally, a seal impression of Hizbul Mujahideen in Urdu was allegedly found at the premises, in the presence of independent witnesses and an Executive Magistrate.
Citing these recoveries, the investigation invoked Sections 38 and 39 of the UAPA, which relate to membership, support, or association with a banned organization.
Following the collection of evidence, the investigating officer concluded that Mian Abdul Qayoom had used his residential premises for concealing incriminatory material and for furtherance of terrorist activities. The residential property, located at Bulbul Bagh, Barzulla, Srinagar, consists of a two-storeyed house along with land measuring 2 kanals, 1 marla, and 90 square feet.
The order further clarifies that the said property, registered under mutation number 338, stands in the name of Mian Abdul Qayoom, son of Mian Abdul Rahim, and qualifies as “proceeds of terrorism” under Section 2(g) of the UAPA. As such, it is liable to attachment under the relevant provisions of the Act.
“Now, therefore, in exercise of powers conferred by Section 25 of UAPA, prior approval is accorded for attachment of the property situated at Bulbul Bagh, Barzulla, Srinagar, in FIR No. 157/2009,” the order reads.
This move marks a significant development in the long-pending case involving senior separatist figures in Jammu and Kashmir and comes amid intensified efforts by law enforcement agencies to crack down on properties linked to terror funding and separatist networks across the Union Territory.
Officials said the attachment has been carried out following “due legal process” and “on the strength of credible evidence collected during investigation.”
Police sources indicate that further legal proceedings regarding the confiscation and disposal of the property will follow as per UAPA procedures once the attachment order is formally executed on ground.
