Diocese of Amritsar : Court asks Crime Branch to probe ‘functioning, embezzlement’ in TBMS

SRINAGAR, Dec 3: A lower court has asked Crime Branch of Police to report on the alleged ‘malfunctioning’ and ‘embezzlement’ in Diocese of Amritsar, Church of North India governed schools in Kashmir.

These schools include Tyndale Biscoe, Mallinson Srinagar, The Kashmir Valley School Budgam and Tyndale Biscoe-Mallinson School Shajimarag, Tangmarag Baramulla.

The order to Crime Branch has been issued by the Chief Judicial Magistrate (CJM) Srinagar on November 28, this year in a petition filed by Rajan Sandhu and Isaax Samuel against Pardeep Kumar Samantaroy, Parvez Samuel Kaul, Mrs. Joyce Kaul, Rahul Rex Kaul, Jaman Singh Thapa and Vijayendra Dhanvantri who are associated with these schools directly or indirectly.

According to the petitioner, the Diocese of Amritsar, Church of North India governs and regulates the oldest and reputed educational institutions of Kashmir Valley aimed at taking the mantle of education to the disadvantaged section of the society.

“That these educational institutions which are governed by the relevant laws and regulations of the society have been illegally and immorally hijacked by one single family which is deliberately trying to change the basic structure of these Diocese run educational institutes, viciously turning them from educational society into their personal business enterprises, overriding the interests of thousands of students and parents, casting a wrong and false impression on the Diocese of imparting education in conflict,” reads a paragraph of the petition filed before the CJM Srinagar.

According to the petitioner the respondents ‘in league with each other’ have gone beyond the guidelines and bylaws of supreme governing authority (Diocese of Amritsar-Church of North India) and have surpassed all extremes by acting reflection on the decades of hard work of the missionaries in providing free and quality education to every section.

Sources in the court revealed to Kashmir Despatch that the same court had ordered a probe into the alleged malfunctioning in these schools in a similar petition last year but the Crime Branch did not complete its probe in a time bound manner.

However, in June 2019, the Crime Branch has given ‘clean chit’ to the accused office bearers of these schools but has concluded that the ‘probe /enquiry is going on and will be concluded on its merits’. 

After this report the petitioner agitated the matter again in the same court and the CJM has issued fresh directions.
