India Cuts Off UN Panel After Jammu & Kashmir Report

Reacting angrily to a submission from the Geneva-based Human Rights Council (HRC) on the alleged violations in Jammu and Kashmir, India has informed the United Nations body that it will no longer entertain any communication with the HRC’s Special Rapporteurs on its report.

The report from the UN body came at the same time a report from two NGOs in the State on the alleged cases of torture was released in Srinagar, which was endorsed by a former UN Special Rapporteur.


Queries on action taken


The current Special Rapporteurs on Extrajudicial Executions, Torture, and Right to Health — Agnes Callamard, Dainius Puras and Nils Melzer — had referred to a June 2018 report of the Office of the High Commissioner of Human Rights (OHCHR) and written to the government in March 2019, asking about steps taken by New Delhi to address the alleged human rights violations listed in the report.


In addition, the Special Rapporteurs had listed “13 cases of concern” from 2018 alone, in which “four children were among eight civilians killed by members of the security forces.”


Rejecting all the claims, the Indian Permanent Mission to the United Nations in Geneva replied to the OHCHR on April 23, saying that “India… does not intend to engage further with these mandate-holders or any other mandate-holders on the issue,” whom it accused of “individual prejudice”.


India had also rejected the OHCHR’s report on the ‘Situation of Human Rights in Kashmir’ — the first-ever such report on Jammu and Kashmir that came out in June 2018 — and accused the High Commissioner of Human Rights Zeid Ra’ad Al Hussein of “clear bias” in bringing it out.


When asked, the Ministry of External Affairs clarified that India’s stand on not engaging with the Special Rapporteurs was only for those wishing to refer to the OHCHR report.


However, UN officials say that India is already in contravention of several Conventions it has committed to, including a “Standing Invitation” signed in 2011 to all special rapporteurs to visit India.

According to the UN records, more than 20 such visit requests, including to Jammu and Kashmir, are pending at present. UN sources also said that between 2016-2018, the OHCHR Special Rapporteurs had sent as many as 58 communications, and had received no response other than the April 23 letter on Jammu and Kashmir.


“The only response so far has been to the communication relating to Jammu and Kashmir….The last visit was by the Special Rapporteur on water and sanitation, in October-November 2017,” a UN communications official said in reply to queries from The Hindu.


Report from NGOs


The UN submission on Jammu and Kashmir coincided with the release of an extensive 560-page report on Monday, prepared by the J&K based Association of Parents of Disappeared Persons (APDP) and the J&K Coalition of Civil Society (JKCCS). The report, entitled ‘Torture: Indian State’s Instrument of Control in J&K’, documented 432 cases of suspected human rights violations and brutality by security forces of which only 27 had been investigated by the State Human Rights Commission.


The report claimed that nearly “70% of torture victims in Jammu and Kashmir were civilians (not militants) and 11% died during or as a result of torture”. The cases included incidents of electrocution, ‘water-boarding’ and sexual torture, which the government has repeatedly denied.
“This report will constitute a landmark. It is hoped it will be an example to other civil society organizations in India and in other countries as a model,” wrote Juan E.

Mendez, former UN Special Rapporteur on Torture (2010-16), in the report’s preface, adding that he had been denied permission to visit India.

Exit polls and their reliability

The exit polls have a history of underplaying mainly the opposition parties in this country.  What is more surprising is the fact, that of the previous three elections, the two in which UPA ended up forming the government at the center, the exit poll had got even the direction wrong.

The exit polls, in recent times, have had a history of guessing the results wrong – both locally and internationally. Domestically, post-2014, the psephologists had predicted an astounding victory of BJP over the then Mahagathbandhan, which was completely opposite of the actual results. In Karnataka state elections last, the pollsters had predicted ruling Congress retain power, however, BJP turned out to be the single largest party.

Internationally also, pollsters had got the Brexit vote wrong, along with 2016 US Presidential Elections – where they had predicted a victory for Democratic candidate Hillary Clinton.

The most recent embarrassment for psephologists was during the Australian federal election results on Sunday morning, wherein they were predicting a victory for Australian Labour Party. However, incumbent Scott Morrison of the Liberal Party of Australia surprised everyone by sweeping the elections.

Right or wrong, everything will be clear and open on May 23. The brains behind these exit polls have sofar been able to create an atmosphere in favour of NDA forming the government. Now what will be the verdict of the people of this country shall be known to all after two days. Till then anybody is free to guess as per his own common sense and the results of television debates.

Schools, colleges in Srinagar to remain closed tomorrow

SRINAGAR, MAY 20: The authorities have ordered closure of all schools and colleges of Srinagar tomorrow on May 21.

The decision to close the said educational institutions has been taken as a precautionary measure in view of the protest shutdown and march calls given by the separatists.

SRINAGAR, May 20: A delegation of senior officers of the Government led by Baseer Khan, Divisional Commissioner Kashmir on Monday visited various areas of the city to take stock of developmental works, sanitation and traffic issues and face lifting of Srinagar City. Representatives of the KCC&I were also invited for identification of issues related to trade and commerce.

The spokesman said that Divisional Commissioner was accompanied by Various senior officers including Shahid Choudhary, Deputy Commissioner, Srinagar, Fayaz Ahmad, Chief Town Planner, Commissioner, Srinagar Municipal Corporation, Vice Chairman, SDA/LAWDA, Srinagar, Chief Engineer PWD (R&B)Kashmir, Chief Engineer PDD (EM&RE)Kashmir, Chief Engineer, PHE Kashmir, Chief Engineer, I&FC, Kashmir, Director, Food Civil Supplies & Consumer Affairs, Kashmir, Senior Superintendent of Police, Traffic City Srinagar, Superintending Engineer, UEED, Srinagar, and Superintending Engineer, S&D, SMC Circle, Srinagar.

Nasir Hamid Khan, Senior Vice President, KCC&I  apprised the visiting officers about various pending issues requiring the attention of the administration. The Divisional Commissioner gave on spot directions for macadamization of parking areas and face lifting of the main shopping area of the Central Business District. The Representatives of Municipal Corporation and UEED were directed to complete the pending storm drain and sewage drain within a period of three weeks.

Hashmat Qazi, Chief Engineer PDD(EM&RE) informed the delegation that the present electricity infrastructure of multiple poles and wires is being drastically reduced by underground cabling and minimization of a number of poles.

With the view of regularization of parking, the Commissioner, Srinagar Municipal Corporation was directed to urgently finalise the installation of computerised parking ticket machines in areas already earmarked in the Central Business District.

The Delegation visited the Skewed Foot Bridge at Raj Bagh. The Divisional Commissioner directed the officials to prepare a feasibility report for the conversion of the Foot Bridge into Motorable one after going through all the directions of the Hon’ble High Court in this regard.

The Divisional Commissioner also visited the under-construction site of the Chamber House at Raj Bagh, Srinagar.

The Delegation also inspected the area near Amar Singh College and Youth Hostel. Several directions were issued for face lifting of the area construction of deep surface drain, making functional all street lights and plantation of trees and improvement of the landscape of the area.

Footpath, drainage, macadamization and electricity works along the Dal Lake were also taken stock of and necessary instructions issued at various places. The visit follows directions of the Hon’ble Governor for setting up of a structured mechanism for regular redressal of various pending issues and day to day problems.

86 militants killed so far this year: Lt Gen Ranbir Singh

SRINAGAR, May 20: Lt Gen Ranbir Singh, GOC of the Northern Command has said that 86 militants have been killed so far in 2019 and around 20 have been apprehended. He said that many were brought back to the mainstream.

 “GOC-in-Chief Northern Command, Lt Gen Ranbir Singh: During this year we have been able to neutralize 86 terrorists so far & our operations continue in the same manner. Nearly 20 of them have been apprehended, we’ve also been able to bring back many of them to the mainstream,” ANI wrote on Twitter. Singh while talking about that Balakot strikes said that it was a major achievement.

 “Airstrikes by IAF on Balakot terrorist infrastructure was a major achievement, wherein our aircraft went deep into enemy territory and struck terror launchpads. Pakistanis carried out air operations the following day, however, they were given a befitting reply,” he was quoted as saying by news agency ANI.

NDA leaders to meet on Tuesday

SRINAGAR, May 20: Top leaders of the BJP-led NDA will meet over dinner on Tuesday with Prime Minister Narendra Modi and BJP president Amit Shah expected to be present, party sources said on Monday.

Bihar Chief Minister and JD(U) president Nitish Kumar, Shiv Sena chief Uddhav Thackeray and Lok Janshakti Party head Ram Vilas Paswan are likely to attend the meeting, which will take place two days before the counting of votes for the Lok Sabha polls on May 23.

A meeting of key BJP leaders, including Union Ministers, is also scheduled to be held in the party headquarters before the dinner meeting with allies.

The BJP’s decision to host the dinner comes following the exit polls which have been unanimous in projecting another term for Modi.

Exit polls telecast by almost all major new channels have forecast that the BJP-led NDA will cross the majority mark of 272 in the 543-member Lok Sabha.

Polls have been held for 542 seats as the Election Commission had deferred the election for Vellore seat due to allegations of the use of money to influence the voting.

Several BJP leaders asserted on Monday that the party will get a majority on its own, repeating the unprecedented feat it achieved in 2014 by winning 282 seats. (AGENCIES)

J&K Situation Is Under Control, 86 Militants Neutralized So Far: Lt Gen Ranbir Singh

Asserting that overall situation in the state of Jammu and Kashmir is under control, Northern Command Army Commander, Lt Gen Ranbir Singh on Monday said that as many as 86 militants have been neutralized so far.

“The security situation in Jammu and Kashmir is well under control,” Gen Singh here told reporters at a press conference after a function organized for educational scholarship distribution to the selected youth of the state.

“As far as we are concerned, we have Line of Actual Control with China where we have been able to ensure to maintain peace and tranquility, the established confidence buildings to ensure that there are no point of rift and also to ensure no frictions take place,” he added and said that if any transgressions or face offs, which do take place, the established mechanisms do take care of that for overall peace and tranquility.

“As regards the Line of Control with Pakistan is concerned, Pakistan has continued with activities, which are mainly anti India like promoting cross border infiltration, ceasefire violations, drug trafficking, narcotics and circulation of fake Indian currency,” said the Army Commander.

He added that all their actions are ensuring the proxy war raged against India is in continuation, adding, “But I assure you that our actions to counter them are in place and the Pakistan will not be allowed to succeed in their designs”.

“As far as the hinterland is concerned, we have recently finished with the elections in the state. It is to the credit of the security forces, administration in the state that we have very peaceful, free and fair elections,” he added.

“While we have ensured peaceful elections, we have also continued our efforts of neutralizing the militants on very hard inputs from various intelligence agencies that led to surgical operations,” the Army Commander said.

He maintained that this year so far, Army has been able to neutralize 86 militants and the operations to neutralize them, is continuing in the same manner.
“Many have also surrendered, many came back and joined the mainstream,” he said.

On February 26 air strikes in Balakote by the Indian Air Force, the General said, “The action by IAF for carrying out air strikes in Balakote militant infrastructure was needed laudable. Our aircrafts penetrated deep into their territory and carried out attacks on launch pads and camps”.

“They also carried out their operations close to the LOC but were given very befitting reply,” he said and added, “our deterrence, our articulation and our military strategy have always been clear. Should there be any misadventure by the Pakistan, there will be given a befitting reply”.

“Indian Armed Forces have the capability, resolve and operational plan to take any challenge from the Pakistan whenever it arises,” he said.

The General said, “militants infrastructure remains intact in POK and Pakistan, we feel that Pakistan’s insincerity to have peace and tranquility with India, which is very pronounced”.

“In case they mean business, they got to dismantle, the terror infrastructure, launch pads and camps which are very close to the LOC,” he added and said, “we are keeping continuous watch on the LOC and whenever any wrong activity is carried out by the Pakistan Army or Armed Forces, suitable response will be given to them,” the Army Commander asserted.(UNI)

40 Kashmiri youth joined militancy in 2019: Army

SRINAGAR, MAY 20 : Lieutenant General Ranbir Singh, General Officer Commanding-in-Chief, Northern Command of the Indian Army on Monday said that almost 40 youth who have picked up arm in Kashmir  in 2019.

Lieutenant General Singh said while addressing the media said that “Local recruitment remains a matter of concern for all of us. Last year, we had 217 local youth who had picked up militancy. This year, the number has significantly reduced and as on date there is only 40 youth who have picked up arms”.

He added that realization is coming in the youth and people of Kashmir that we do not want to become fodder by the Pakistani agencies and various inimical elements, who want to promote terrorism and violence in the state of Jammu and Kashmir.

He added “I am sure with the help of all the stakeholders we will be able to arrest this trend in the times to come as we are doing now”.

Custodial Disappearance: Informer sent to jail, the family demands action against BSF officer too

 A family from Hazratbal Srinagar Monday demanded that besides the Informer, a BSF officer responsible for the disappearance and death of their loved one in 1992 should also be arrested without any delay. 


The fugitive Informer of BSF whom police identified as Azad Mir alias Asghar was recently arrested by Crime Branch Kashmir after 27 years from Muzafarpur Bihar.


   Police Station Nigeen had registered an FIR vide number 44/1992 under section 302, 344, 364,348, 201, 109, 102B RPC against one Azad Mir alias Asghar son of Muhammad Sultan, a resident of Nigeen Srinagar after a complaint was filed by one Fayaz Ahmed Bazaz of Hazratbal who in his complaint accused Azad Mir of killing his brother Sajad Ahmed with the help of Deputy Commandant 30 Battalion BSF DS Rathore. 


  BSF officer Rathor during a night raid picked up deceased Sajad Ahmed Bazaz on the instruction of their dreaded Informer Asghar on February 12, 1992, family told news agency. “The High Court taking cognizance of the petition filed by us appointed a Commissioner to investigate the case who held BSF officer DS Rathore responsible for custodial disappearance, however, despite the accused officer being identified by the aged father of the deceased son, the Home Ministry of India didn’t grant any sanction to prosecute DS Rathore.”


    The then SHO Police Station Nigeen issued a certificate to Ghulam Muhammad Bazaz, the father of slain Sajad Ahmed Bazaz confirming the arrest and subsequent disappearance of Sajad.


     When the accused fled from Kashmir the case was handed over to Crime Branch. The Crime Branch Kashmir too failed to nab the accused despite making hard efforts, however, recently it managed to arrest the absconder from Muzaffarpur Bihar. The accused was produced before the Court where on the directions of Court he was sent to Central Jail Srinagar.


   The family demanded that action should also be initiated against the BSF officer. They said that both BSF officer this dreaded informer are involved in many custodial disappearance cases. (CNS)

Peacs predicts hung parliament, BJP may emerge winner in J&K too

New Delhi, May 20, : Platform for Election Analysis and Community Studies (PEACS) has predicted hung-parliament this time though four out of five exit polls conducted by English television channels along with agencies have predicted a thumping win for the BJP-led NDA for a second consecutive term in the Parliament.   


    For the Exit Poll, PEACS interviewed over 80,000 voters in 125 Parliamentary Constituencies. An official from PEACS said that out of 543, a total number of 125 Parliamentary Constituencies were selected at a random manner. 3200 polling station were selected for conducting interviews while at a polling station, around 25 interviews were randomly selected. 


   After analysis, it has come to fore that there may be a hung parliament. BJP led NDA may get 265 to 285 seats while UPA may get 135 to 125 seats. All India Trinamol Congress may emerge the single largest regional party and may bag 30 to 35 seats while SP and BSP may get 40 to 45 seats. 


Only NewsX-NETA exit poll has predicted a hung Parliament while the Times Now-VMR, Republic-C Voter, and Republic-Jan Ki Baat, have all predicted a majority for the NDA, with many of them even going on to predict an absolute majority for the BJP alone.


   The PEACS in its Exit Poll for Jammu and Kashmir has claimed that PDP and NC may get 1 to 2 seats each, Indian National Congress 1 while BJP may get 2 to 3 seats for the Parliament. 


   In the 2014 Parliamentary elections, the BJP went comfortably past the halfway mark of 272 in the 543-member House, with 282 seats. (CNS)
