EC gets expert advice to begin J&K poll process

0

New Delhi: The Supreme Court verdict on a 2002 Presidential Reference mandates EC to start the process of holding assembly elections in Jammu and Kashmir immediately, if it is convinced the environment is conducive for free and fair polls, former additional solicitor general Vikas Singh has told EC.

Singh in his advice said it was incumbent on the poll panel alone to take the decision, as outlined in Article 324(6), it is learnt. The poll panel had sought Singh’s legal opinion “in the context of the ongoing President’s rule in Jammu & Kashmir.”

EC is yet to take a final view and is examining all aspects of the issue.

The J&K government and Union home ministry had in written replies expressed inability to provide enough security forces for holding immediate assembly elections.

However, Clause 6 of Article 324 says “the President, or the governor of a state, shall, when so requested by the Election Commission, make available to it or to a regional commissioner such staff as may be necessary for the discharge of the functions conferred on the Election Commission.”

The SC had cited Article 324 in its 2002 verdict to say the “question of whether free and fair election is possible to be held or not has to be objectively assessed by the Election Commission by taking into consideration all relevant aspects. Efforts should be to hold the election and not to defer holding of elections.”

ET had on April 29 reported that EC’s three special observers appointed in March to assess the ground situation in J&K had suggested a “post-Lok Sabha election window” for assembly polls after discussions with political parties and officials.

However, MHA and the J&K administration recently told EC in an April 26 meeting that polls should be held either in September or October-November, citing security requirements for the tourist season, Ramazan and Amarnath Yatra.

Need For Introspection

0

The rape of a three-year-old girl in Sumbal area of Bandipora district in north Kashmir is the most shameful act and against the human values. An increase in the crime rate anywhere is an opportunity to look at society and at ways to reduce crime through prevention and intervention.

For the past few decades in Kashmir there has been an upsurge in criminal activity, primarily perpetrated by young men.

These criminal incidents have been quite disturbing, as Kashmiri we are becoming a people who are way too passive and reactive when it comes to these societal issues. No one wakes up one day and decides to get involved in criminal activity. It has a root, but many of us do not seek to find out what that is. We just like to offer our own suggestions about what punishment the offender should receive.

When a child is born, he or she normally has parents and extended family members who seek to raise them with the necessary values and morals needed in order to develop a good character for the future. The family’s behaviour should be a prime and positive example of what the child should be striving to emulate. But, due to the fact that we do not live in an ideal world, this is not always possible.

We need to start helping our young sons before they imbibe criminal tendencies. We need to stop saying “it is not my problem”. For when that young man grows up and his issues spiral out of control so badly that it affects your children, then we want to take it seriously. Crime does not occur in a vacuum. It affects all of us.

BJP didn’t scrap Article 370 because of ‘sensitive situation’ in Jammu and Kashmir: Gadkari

0

New Delhi: The Modi government did not scrap Article 370, which grants special status to Jammu and Kashmir, because of “sensitive situation” in the state, Union Minister Nitin Gadkari has said.

Senior BJP leader Gadkari, however, maintained that the party is committed to scrapping this special provision in the Constitution.

In an interview to senior journalist Karan Thapar, he said Kashmir needed more industry and investment to create employment, but Article 370 came in the way of getting land.

Asked if abrogation of Article 370 could break the link between Kashmir and other parts of India, Gadkari said the party has been committed to its scrapping but did not do so despite full majority in the Lok Sabha due to the situation in Jammu and Kashmir.

“Our party has been committed to abrogating Article 370 for long. But because of the sensitive situation there (J&K), we aren’t doing it. We were in power with full majority this time, still we are not going to implement it. However, as far as the party’s philosophy, policy and approach to it (Article 370) is concerned, we are firm on it,” the minister said, according to the transcript of the interview.

“Because of the sensitive situation, it’s not appropriate to implement that. But as far as the party is concerned, for the past many days, it is there,” he added.

Article 370 grants special status to Jammu and Kashmir and the BJP has been for long promising to abrogate it.

Answering another query on Article 370 and annulling of Article 35A, which grants special privileges and rights to the “permanent residents” of the state, Gadkari said: “We need more hotels, restaurants, resorts. We need to increase tourism. But because of Article 370, no one can purchase land there. IT firms can’t establish their companies there. And that’s the reason people are not getting employment.”

When pointed out that land can be acquired from the state government on lease for 100 years, he said that no big hotel companies like the Taj or the Oberoi were in a position to start a hotel in Kashmir.

“They don’t want to expand now. I have held discussions with them. Because there are a lot of legal problems due to this law, they can’t construct there, cannot expand. That is the problem,” said Gadkari, who holds the portfolios of Roads and Highways, Shipping and Water Resources.

Asked if the situation in Kashmir had deteriorated sharply under the Modi government, Gadkari said, “It is not because of the people of Kashmir. It’s because of Pakistan.

“Again, I want to repeat the same thing. After three wars with us, Pakistan has realised that they can’t win against India like that. So they have resorted to proxy war, by supporting terrorists and terrorist organisations, and they are creating problems. Some of the incidents in Kashmir are happening because people of Pakistani origin are coming to Kashmir and creating problem. It is a proxy war.”

He said there’s a section of people supported by the Pakistani government who want to create trouble.

“And when we fight them, they take shelter behind the Kashmiri people, making it look like a war between Kashmiri people and Indian forces,” he said.

Gadkari further said that economic progress of Kashmir was on the party’s agenda.

“Actually, in my own department, we have started work worth Rs 40,000 crore in Kashmir. We are building roads, tunnels. The government has taken many decisions to support Kashmiris,” he said. (IANS)
