HC notice to govt on pleas against highway ban order, govt asked to file response tomorrow

Srinagar, April 8 : The J&K High Court has sought a response from government on tomorrow on petitions against the closure of two days a week of the highway from Baramulla to Udhampur.

A division bench comprising Chief Justice Geeta Mital and Justice Tashi Rabastan issued the notice which was accepted by senior additional advocate general to the government. “The government was directed to come with alternate arrangements and other suggestions by tomorrow.”

The petitions have been filed by a lawyer, Mir Shafaqat Nazir, and Shah Faesal, the former IAS officer who floated a political party earlier this year and both are seeking directions to quash the state home department’s April 3 order.

“The (Principal Secretary to government), Home Department, Civil Secretariat has issued an arbitrary and capricious order dated 03.04.2019 in terms whereof two dedicated days in a week viz. Wednesday and Sunday have been kept for movement of security forces’ convoys, when there would be no civilian traffic on highway from Baramulla through Srinagar, Qazigund, Jawahar Tunnel, Banihal to Ramban till Udhampur from 4.00 A.M. to 5.00 P.M,” Shafaqat submits in the petition.

“The order is illegal and unconstitutional having been issued in violation of the rights guaranteed to the petitioner under Article 14, 19 and 21 of the constitution,” he said.

Shafaqat told GNS that under Section 144 CrPC, only an executive magistrate can place restrictions on the movement of people in urgent cases of apprehended danger etc.

“(Principal Secretary to government, Home) has no power or authority to pass an order placing restrictions over the movement of people. The impugned order is as such, non est in the eyes of law and deserves to be quashed,” he said.

Dr. Shah Faesal has termed the ban as a violation of fundamental rights guaranteed under Article 19 and 21 of Indian constitution.

The Faesal’s PIL is argued by advocates Tasaduk Khuwaja and senior council of Supreme Court advocate Ehsan Javed along with some other advocates. (GNS)

RDD Employee Stabbed To Death In South Kashmir, Accused Held

Srinagar, April 8 : An employee of Rural Development Department (RDD) was stabbed to death during a fight between him and an individual over water dispute in Shopian district of south Kashmir.

Reports and officials told GNS that the employee (GRS) identified as Adfar Rashid Parra alias Kamal son of Abdul Rashid of Homhoona had gone to see his orchard at Urpora where he and the individual Bilal Ahmad Seh son of Abdul Ahad entered into a verbal duel.

The fight took an ugly turn when Bilal stabbed Adfar in his chest as a result of which he was gravely injured and removed to Sub-District hospital Zainapora where he was declared as brought dead.

The deceased was engaged only yesterday and was getting married later this year, family sources said.

A doctor said that Adfar had injuries due to some sharp-edged weapon, presumably a knife.

A police officer told GNS that Adfar was stabbed to death and a case under FIR number 19/2019 302 RPC has been registered.

The officer said that the after hectic efforts the accused Bilal has been arrested by the police station concerned in connection with the murder.

Asked whether the killing was due to the dispute over water, the officer said that all the angles will be looked into. (GNS)

Summoning Mirwaiz by NIA extremely condemnable: UJC

Srinagar, April 8: United Jihad Council (UJC) has termed the summoning of Mirwaiz Umar Farooq to Delhi by NIA for questioning as extremely condemnable and said such attempts to weaken the “freedom struggle” of Kashmiris are bound to fail.

“Such attempts to weaken the freedom struggle of Kashmiris through NIA have failed in the past and will continue to fail this time too,” a UJC spokesperson Syed Sadaqat Hussain in a statement issued to GNS said.

He termed the summoning of Mirwaiz Umar Farooq to Delhi as frustration of the Government of India.

The spokesperson also sought clarification on the “ambiguous” words like “criminals, extremism and terrorism” used in a press release issued by Hurriyat Conference (M) in response to NIA summon to Mirwaiz.

“The ongoing movement demands unambiguous clarification of such words so that there is ideological unity among the ranks of those associated with the struggle,” he said. (GNS)

Hospital Medicines worth lakhs recovered from Medical Shop in Bandipora

Srinagar, April 8 : Authorities on Monday seized a large quantity of medicines meant for hospital supply in a private shop in Bandipora district of north Kashmir.

An official told GNS that following an information about sale of hospital supply medicines in a medical shop at chitteybandy area of Bandipora district, Drug Inspector along with a team of officials on today raided medical shop of One Zahoor Ahmad Malla Son of Mohd. Ramzan Malla Resident of Chitteybandy and seized huge quantity of medicines included Glanstill Injection of SKIMS Supply, NS Gulcose- JKMSCL Supply, Triglon Injection-SKIMS Supply, Ceftriaxone Injection-JKMSCL Supply, Infusion set-SKIMS Supply, Cetrizine Tablets-JKMSCL Supply, Compound sodium lactat Injection-JKMSCL supply, Rolled Bandage-Hospital Supply, Dextrose-JKMSCL supply, Axapara Injection- SKIMS, Medroxy progesto injection-Free supply under Antara Programme of Govt of India.

The seized medicine, which according to the officials is worth lakhs of rupees, is the hospital supply and was meant to be distributed among poor patients.

“We seized the huge quantity of medicines at chitteybandy area,” said Bilal Ahmad Rather, Drug inspector Bandipora.

“Among the retrieved medicine include huge quantity of antibiotics, Contraceptive injections and other medicines meant for free supply”.

The team onspot sealed the medical shop, he added that an inquiry has been initiated to ascertain why this medicine, which was meant for the needy patients in the hospital. Most of the poor patients who cannot buy medicine from the market have often complained that the hospital authorities are not providing medicine to the needy patients. (GNS)

Srinagar, April 8: People’s Conference chairman Sajjad Gani Lone Monday claimed that National Conference vice president Omar Abdullah had held a secret meeting in New Delhi following the 2014 Assembly elections in Jammu and Kashmir .

” He has till tomorrow to reveal who he met for two and a half hours and begged support for J&K chief minister’s post after the results of 2014 Assembly elections were announced,” Lone told reporters in Kupwara.

“If he doesn’t then I will reveal it myself tomorrow,” he said.

Lone castigated Omar for blaming the PDP-BJP government for NIA issuing summons to Mirwaiz Umar Farooq.

The NIA was created during the rule of NC’s ally Congress at the Centre, he said, and asked why Omar and his father Farooq Abdullah had remained silent on the issue back then.

Lone said his party was mulling to move the High Court over government ban of civilian traffic on highway two days a week. (GNS)

Srinagar, April 8: National Conference vice president Omar Abdullah Monday accused the BJP of using turmoil in Kashmir for electoral gains.

“They don’t want the situation in Kashmir to improve because they use turmoil here to do politics in the rest of the country,” he said.

Omar was responding to a query on the BJP’s pledge in its manifesto to fight militancy in Kashmir.

“Instead of saying that they will continue to fight militancy, BJP should have promised to create conditions in Kashmir that would wean youth away from militancy,” he said.

He said decisions like banning civilian traffic on highway two days a week would only fuel further anger among the people.

SHRC seeks latest status of investigation into 1994 Kupwara massacre

Srinagar, April 8: The State Human Rights Commission has sought a latest status of investigation into the massacre at Kupwara on 27 January 1994 and warrant against the accused army personnel including then lieutenant G D S Bakshi.

Police had filed FIR (19/1994) under RPC sections of 302 (murder), and 307 (attempt to murder) police at station Kupwara.

The SHRC chairperson Justice (Retd) Bilal Ahmad Nazki issued notice to the government on a petition filed by International Forum for Justice Human Rights JK through its chairman Muhammad Ahsan Untoo, the petitioner said.

Untoo said a report has been filed by Inspector General of Police CID J&K which reveals that the enquiry conducted after receiving the information from reliable sources that “the troops deployed at Kupwara town under the command of 2nd lieutenant GD S Bakshi indiscriminately fired in bus stand Kupwara without any provocation and justification with criminal intention which resulted in the killing of several persons besides injuries to many others.” He said police station filed an FIR no. 19/1994 under section 302, 307, 449 RPC.

He added: “During the investigation it is admitted in the report that the massacre was done under the command of GDS Bakshi, lieutenant 31 Madrass regiment.”

In the report, as per the petition, police served notice to Bakshi through GoC Northern Command to appear before investigation officer of instant case but the concerned unit failed to cooperate with the investigating agency. He said that despite notice by SHRC and courtof JMC Kupwara, the army has not cooperated with the investigating agency.

“It’s crystal clear that during the investigation the concerned officer namely GDS Bakshi and the soldiers under (his)command killed the innocent people without any justification or provocation,” the petitioner said urged commission to order “coercive measures” and issue warrant against the accuse persons so that the investigation of the innocent killings comes to the conclusion.

According to GNS, the petitioner has also sought directions to the government for furnishing bio-data of the deceased and injured in the incident. (GNS)

Shah Faesal challenges highway civilian traffic ban in J&K High Court

Srinagar, Apr 08 : Dr. Shah Faesal today challenged the highway traffic ban before the High Court of Jammu and Kashmir termed it as a violation of fundamental rights guaranteed under article 19 and 21of Indian constitution.

Dr. Faesal filed a PIL (OWP) 06 of 2019 titled Shah Faesal vs State of Jammu and Kashmir and others seeking quashment of government order dated 03/04/2019 that banned the public traffic movement on national highway two days in a week (Wednesday and Sunday).

The PIL was heard today by the division bench comprising Chief Justice Geeta Mital and Justice Tashi Rabastan. The court issued the notice accepted by senior AAG to the government. The government was directed to come with alternate arrangements and other suggestions by tomorrow.

The case is directed to be on board for tomorrow for arguments. The PIL is argued by senior council advocate Tasaduk Khuwaja, senior council of Supreme Court advocate Ehsan Javed and some other advocates. (KNS)

BJP’s article 370, 35A bogey in manifesto a poll gimmick to polorize ahead of election: Dr Veeri

Srinagar : National Conference South Kashmir Zone president and former MLC Dr. Veeri has rebuked BJP on thier manifesto to abrogate special status of the state.

While calling the move a poll gimmick, Dr. Veeri said that BJP couldn’t not do anything in past 5 years despite overwhelming majority and is now playing this card to polorize for poll gains.

“There is nothing new in BJPs manifesto as far as their stand on article 370 and 35 A is concerned, this special status bogey of theirs is not for any benefit of people but only to polorize votes for their personal gains,”Dr Veeri said adding that it’s ironic that the party couldn’t do anything about Kashmir’s special status despite having a huge mandate and now is again racking up the issue to divide people.

Dr. Veeri said that article 370 is the only bridge that connects Kashmir with new Delhi and if the same is demolished Kashmir will technically become independent.

While reacting to the Mirwaiz summons by NIA, Dr. Veeri said that these acts are done only to intimidate people and such things will fetch nothing.

“During Vajpayee government same hurriyat was invited for talks and the then administration invited them with full protocol saying that hurriyat represents aspirations of the large section of Kashmiri people, Now same hurriyat is being intimidated,” he said.

Dr. Veeri said that BJP by creating a wedge between Kashmiris and people outside state by associating former with Pakistan are just tactics for elctroral gain through polorozation.

Suspected Militants Lob Grenade On CRPF In Nowgam

Srinagar, April 8 : Suspected militants on Monday lobbed a grenade on a CRPF bunker at Gulshan Nagar, Nowgam in outskirts of Srinagar City.

Reports reaching said that the suspected militants hurled a grenade on CRPF 117 bn bunker Gulshan Nagar, Nowgam.

Confirming the incident a police officer told GNS that the device, however, did not explode.

The officer said that Bomb Disposal Squad reached the spot and the device is being defused. (GNS)
