Grenade attack on Tahab camp in Pulwama

Srinagar, January 25:(GNS) Suspected militants lobbed grenade towards Tahab camp in South Kashmir’s Pulama district on Friday evening.

Reports reaching GNS said that suspected militant lobbed grenade towards Tahab camp which exploded outside gate of Tahab camp.

A senior Police officer confirmed to GNS that militants lobbed grenade on Tahab camp which was retaliated by forces by firing some gunshots.

The officer said there was no loss of life or injury reported. The whole area has been cordoned off to nab the attackers.(GNS)

Murder of Article 370

Worse followed. In 1963, a directive was sent by New Delhi to Srinagar—integrate. In breach of the Delhi Agreement of 1952, flouting Kashmir’s strong commitment and the Assembly’s unanimous resolution for an elected Head of State, the Constitution of Jammu & Kashmir (Sixth Amendment) Act, 1965 was enacted to replace the elected Sadar-i-Riyasat by a Governor appointed by the Government of India—removable or transferable at its will.

This is void because it destroyed “the basic structure” of the Constitution. In the famous Keshavanand Bharati Case (1973) 4 SCC 225, the court held that “the Republican and Democratic form of Government” was part of the basic structure. Removal of an elected head of State and imposing in his place a Governor nominated by the Centre flouts the basic structure as well as the federal principle. This applies also to the President’s orders under Article 370. They also wreck the basic structure of the autonomy of the State.

This is quite apart from the fact that those orders by the President flout the very terms of Article 370. Any order which increased the Centre’s powers or extended to Kashmir constitutional provisions additionally required ratification by the Constituent’s Concurrence and was valid only until the Assembly was convened. It had to ratify the Government’s Concurrence. Once the Assembly ceased to exist, no Presidential order could at all be made thereafter, for the ratifying body was gone. The Constituent Assembly met first on October 11, 1951. The State government’s power to concur with the Centre on its amassment of power over the Centre was gone. The Assembly dissolved itself on November 17, 1956. Yet, 47 such illegal orders were made after November 17, 1956, with “the Concurrence” of the State governments. The latest was last year on goods and services tax (GST).

The murder of Article 370 does not stop there. It empowered the President to extend to Kashmir provisions of India’s Constitution, subject to the stated limitations. It certainly gave no such power to the President to amend the State’s Constitution.

On July 23, 1975, the President made an Order. No. C.O. 101, supposedly under Article 370, to amend the State’s Constitution to debar the State’s Legislature from amending Kashmir’s Constitution in respect of the Governor, the Election Commission, and even the composition of the upper house, the Legislative Council “being matters specified in Sections 138, 139, 140 and 50 of the Constitution of Jammu & Kashmir” unless it received the President’s assent—that is, the Government of India’s consent. Section 147 of the State’s Constitution requires the Governor’s assent for constitutional amendments.

This was in pursuance of Paragraph 5 of the Agreed Conclusions signed by Mirza Afzal Beg and G. Parthasarathi in New Delhi on November 12, 1974, doubtless with the approval of their respective principles, Sheikh Abdullah and Indira Gandhi. It was not a constitutional document which the Prime Minister of India signed with a political leader as part of power sharing. When she withdrew support to him forcing his resignation, the entire accord of February 1975 collapsed. It was like the Punjab Accord (July 24, 1985) the Assam Accord (August 15, 1985) and the Mizoram Accord (June 30, 1986). The Kashmir Accord was explicitly a “political accord between us” as Indira Gandhi wrote (December 16, 1974). She broke the political basis in March 1977 wrecking the entire accord.

The net result is that out of the 395 Articles of India’s Constitution, 260 were extended to Kashmir. Out of the 97 entries in the Union List, 94 were extended; most illegally. It is this husk of Article 370 which the Ram Madhav-Haseeb Drabu Accord of 2014 perpetuated. The 1975 Accord was humiliating. The Shimla Accord of 1972 impaired Sheikh Abdullah’s power to bargain. The 1975 Accord was, nonetheless, a humiliation. Mufti Mohammed Sayeed had a better option. He preferred, as did Mehbooba, to sell his people’s rights for a part with the Bharatiya Janata Party. The Ram Madhav-Haseeb Drabu Accord was worse than a humiliation. It was a despicable betrayal. Kashmir’s history is marred by such betrayals.

It, is of course, perfectly legitimate, rightful and constitutionally valid of Kashmir’s Assembly to pass a resolution expressing its view that the illegalities mentioned above are not acceptable.  (Courtesy: Frontline Magazine)

Those Talking Autonomy Are Enemies Of Kashmir :Er. Rasheed

On the occasion rich tribute were paid to those who were butchered by men in uniform 28 years ago and people took a pledge that they will not compromise the huge sacrifices and will not surrender before New Delhi’s might. Prominent social and religious scholar Manzoor Ahmad Kirmani asked leadership to introspect why Kashmir resolution is still a distant dream. Senior Journalist and member of civil society Javid Zargar appealed for unity among masses and added that leaders needed to be made accountable.

Molvi Shabir Rather said that Handwara massacre is like a blot on India’s face. Student leader Zubair Ahmad asked main stream politicians not to dilute the Kashmir cause. Speaking on the occasion Er. Rasheed said that though we are all pained for not getting the justice but every colonial power has been using the methodology of denying justice to victims, humiliating them and justifying their sufferings. Er. Rasheed said “While New Delhi had nothing to offer but Kashmiris cannot surrender their legitimate rights.

Those always in search of opportunity to harm, humiliate and insult Kashmiris have been given free hand and all these incidents add the perception on the ground that Kashmiris and Indians are like north poles south pole. The way speakers at Indoi-analytics conclave were given free hand in New Delhi to provoke masses all over India against Kashmiri students and businessmen who are residing in rest of India”.

Er. Rasheed added why should Kashmiris reconcile if from security agencies to intelligence agencies and from goons to fringe and radical elements have been getting liberty since decades to throw their venom against Kashmiris. He added by denying justice to victims of Handwara massacre New Delhi has brought bad name to its reputation and its claims of being a country run through rule of law carries no weight. Rejecting autonomy and other proposals as a resolution to seventy year long Kashmir dispute Er. Rasheed reiterated that any attempt to dilute UN resolutions will harm Kashmiri and will create nothing except confusions.

Dilawar Mir, Yawar Mir acclaim Governor for grant of reservation to Pahari community

SRINAGAR, Jan 25: Former minister Mohammad Dilawar Mir and former MLA Rafiabad Yawar Dilawar Mir have welcomed the Jammu and Kashmir Government’s decision of providing three per cent reservation to the Pahari community.

In a joint statement issued here, the two leaders have termed the government pronouncement a ‘historic decision’ that is aimed at socio-economic and educational empowerment of Pahari community in the state.

“This is a landmark decision taken by the Governor of Jammu and Kashmir Shri Satya Pal Malik Ji. We appreciate and welcome this decision of far reaching results for the upliftment of Pahari community,” they observed.

The two leaders said the Pahari community was neglected in terms of improvement in its social status and they had often raised their voice for redressal of their long pending demand.

“But as they say, it is late than never. The reservation granted to this community by giving assent to the J&K Reservation (Amendment) Bill, 2014 providing reservation to Pahari community in Government jobs, the Governor has fulfilled a long pending demand of this community,” the two leaders remarked.

They further observed that by giving reservation to this tribe which was sofar vulnerable to poverty, economic and social backwardness, the present dispensation in the state has taken an exemplary step to alleviate these problems.

Ahead of Jan 26, cop injured in Anantnag grenade explosion

Srinagar, Jan 25 : A day before January 26, a policeman was injured after militants lobbed a grenade in police post near bus stand in Anantnag town of south Kashmir.

Reports reaching GNS said that the militants lobbed a grenade towards police post. In the blast, a policeman sustained splinter injuries and has been taken to district hospital Anantnag.

The injured has been identified as constable Sajad Ahmad.

Meanwhile, there was another blast inside police station Srigufwara but its nature could not be ascertained immediately.

Deputy Inspector General (DIG) of police South Kashmir range Amit Kumar said that a grenade was lobbed at police post near bus stand Anantnag in which one cop suffered minor injuries.

Asked about the explosion at Srigufwara, the DIG said that nothing of sort has happened there. (GNS)

Stranded passengers protest in Jammu; demand airlifting

JAMMU, Jan 25:  Stranded passengers travelling back to Kashmir on Friday protested in Jammu urging government to airlift them immediately. They also asked government to take immediate steps to clear road and to help the families stuck.

“Government should air lift stranded passengers as there are women and children who are suffering badly,” protesters said. The Srinagar Jammu highway has been closed five days back due to snowfall and landslides. 

Huge snow avalanche had come down near Jawahar tunnel as well. According to traffic officials almost 800 people are stranded due to closure of highway, the only road connectivity of Valley to rest of the world.

According to KNO correspondent stranded families assembled in  General Bus Stand Jammu asking authorities to take serious note of difficulties they are facing. “What’s stopping government from airlifting people to valley.  Will they only airlift the dead,” they said.

They said had the administration been serious they would have been all to valley in five days. “Does  this government was us to accept that they cannot airlift us because they just cannot.  They can,  only if they want to,” they accused. 

“Every day the officials tell us that road will be open tomorrow but since five days road is closed and it seems no early it will be opened,” they said. Many stranded families claimed that market prices of commodities has sky rocketed as there is no market checking squads trying to put order in place. 

“Some of the shopkeepers are taking undue advantage of our miseries,” they claimed.”Many of us had been to doctors and hospitals but now there is crash crunch,  since we had planned to be home at earliest,” they said.

They also said that accommodation facilities should have been arranged by the authorities or at least should have put a check  fleecing by people here. “What purpose does this government serve if it leaves it’s  people on roads and lives on assurances.

Promises don’t get you food, medicines and payment of bills,” protesters said. They urged governor to take stock of situation so that people have a sigh of relief. (KNO)

‘Luka Chuppi’to release on 1 March 2019

Bollywood actor Kartik Aaryan, who has garnered a massive fan following owing to his charming looks and versatile acting, is all geared up for his first collaboration with actress Kriti Sanon. The duo has teamed up for Dinesh Vijan’s upcoming production venture Luka Chuppi. The movie has been directed by Laxman Utekar and Kartik recently unveiled the first poster of his film on his social media. 

The 28-year-old actor shared the poster with the caption, “Pakde jayenge ya denge sabko chakma?

The poster has Kartik and Kriti putting fingers on each other’s lips while the latter is seen holding a wedding garland in her hand. 

Kartik and Kriti’s first collaboration will hit the theatres on March 1 and will have a box office clash with Sushant Singh Rajput and Bhumi Pednekar’s Sonchiriyaand with Arjun Kapoor and Parineeti Chopra’s Sandeep Aur Pinky Faraar. Check out Luka Chuppi‘s first poster below.

‘We forgive him because he said sorry’ – Faf du Plessis on Sarfraz Ahmed’s taunt

South Africa captain Faf du Plessis has said his team has forgiven Sarfraz Ahmed for his racially charged on-field taunt during the second ODI in Durban on Tuesday.

“We forgive him because he said sorry,” du Plessis said after South Africa’s training session on Thursday. “He has apologised and taken responsibility for it. It is out of our hands and ICC will have to deal with it now.”

The ICC has received a report from match referee Ranjan Madugalle and is currently considering the matter. Because of the nature of the incident, legal officials have been involved and very little has emerged about what, if any, action will be taken.

Sarfraz was caught on the broadcast stump mics making what seemed to be a racist comment towards allrounder Andile Phehlukwayo during the course of South Africa’s tense chase at Kingsmead.

Sarfraz was caught clearly on the stump mics saying, in Urdu: “Abey kaale, teri ammi aaj kahaan baitheen hain? Kya parwa ke aaye hai aaj?”

Translated literally that is: “Hey black guy, where’s your mother sitting today? What [prayer] have you got her to say for you today?”

Sarfraz issued a general apology via Twitter the day after the incident, claiming that his comments were “not directed towards anyone in particular.”

“When you come to South Africa, you have to be very careful when you make racial comments,” du Plessis said. “I am sure he didn’t mean it like that but he has taken responsibility and we will have to see what the outcome of that is going to be.

“We’re not taking it lightly, but that fact that there was an immediate apology shows there is regret. We can forgive but that doesn’t mean we brush it under the table.”

Phehlukwayo has made no comment on the incident, and du Plessis suggested that he had not noticed the comment at the time – the language barrier meaning Phehlukwayo did not understand what was said.

“Andy [Phehlukwayo] says he didn’t even notice it and thus felt it wasn’t really directed at him,” du Plessis said. “I suppose maybe because we didn’t understand it makes a bit of a difference.”

Breaking the tension, du Plessis ended his response to the incident with a light-hearted comment: “We’re a very gracious team. We forgive easily. Maybe not so much when it’s Australia.”

PUBG addiction causes severe headache to teenager, advised to stop playing PUBG

Srinagar, January 24 : While PUBG addiction and Android phone gaming disorders is talk of town after Doctors Association Kashmir (DAK) sounded alert and described it as ‘more serious than drug addiction’, a first case of PUBG addiction was diagnosed at Government Health Centre Dargah Srinagar.

An adolescent male who presented to facility with right eye pain and persistent headache was diagnosed as suffering from PUBG addiction and doctor has advised him to stop playing the game.

Pertinently, Doctors Association Kashmir (DAK) and different religious organizations have sounded alert and advised teachers, preachers, parents to restrain their kids from playing such games.

President, DAK Dr Suhail Naik while talking to said that “gaming disorders” is now recognized disease in medical sciences recently coined by world health organization and if people are not educated about the adverse outcome of PUBG game, it will destroy future of whole generation.

“We have seen boys traveling to other districts to play internet game when internet services were snapped in their district . These kids have developed psychiatric and behavioural disturbances. They have developed lot of problems in Social, interpersonal and family relations also,” Dr Naik said.

Hospital staff goes on strike after police stops ambulance for 95 minutes in Lolab

Srinagar, Jan 24 (GNS): Most of the staff at Sub District Hospital Sogam on Thursday observed for half an hour protest against stopping of an ambulance by Special Operation Group (SOG) of Police for 95 minutes in northern Kupwara district.

Hospital staff told GNS that one ambulance (Sumo type) bearing number JK09A-0812 of SDH Sogam Lolab after dropping a patient at Khodi Gagal was stopped for about 95 minutes by SOG Naka party near Badibera area.

“Two policemen stopped the ambulance. Despite requests by the driver, police kept him waiting,” they said.

“The policemen even took the key from the driver,” they said. Later BMO Dr Firdous on being informed by the driver reached the area and urged the police to allow the ambulance as it was against high court and supreme court guidelines.

However, they said, that police did not allow the ambulance to go despite the request. Thereafter, they said, the BMO left and kept the ambulance there.

On hearing about it, the staff went on strike and in the meantime, SHO concerned reached the hospital and urged them to call off the strike and also assured action against the erring cops. “He brought the ambulance to the hospital on his own,” they said following which the staff called off the strike.

They said at the time of the incident, the theatre was open and a number of surgeries were conducted. Halting of Ambulance by these policemen for 95 minutes risked the lives of these operated patients, the staff said.

BMO Dr Firdous told GNS said that he tried his best to persuade policemen to allow the ambulance but they did not paid heed.

“After they refused to allow the ambulance, I left it there,” Dr Firdous said, adding, “Later SHO concerned visited the hospital and assured he will take action against the erring policemen.”

A senior police officer refuted the allegations and said that there was a Naka set up in the area in wake of the January 26.

“The ambulance was stuck in a queue and the policemen tried their best to ensure that the ambulance is let go on priority,” the police officer said.

The hospital staff, meanwhile, demanded an investigation and action against the policemen who stopped the ambulance. (GNS)
