BJP Anticipating Supreme Court Verdict on Article 370: JKPM

Srinagar, November 24: J&K Peoples Movement (JKPM) Vice President Advocate Syed Iqbal Tahir has questioned the wisdom of BJP claiming that issue of Article 370 was not sub-judice.

Reacting to a recent statement of a BJP leader Shahnawaz Hussain, Iqbal Tahir said that the statement of the said BJP leader was reflective of BJP’s arrogance and disdain towards the institutions of the country.

Iqbal Tahir reminded BJP that various petitions including the one filed by JKPM is pending before the Hon’ble Supreme Court. “The petitioners have argued that repealing of the Articles 370 and 35A has resulted in taking away the rights of its citizens without their mandate. The petitioners have also argued that the Jammu and Kashmir (Reorganisation) Act, 2019 passed by the Parliament and the subsequent orders issued by the President of India were ‘unconstitutional’. The petitioners have also said that the Presidential Orders are violative of fundamental rights guaranteed under Article 14 and 21 of the Constitution to the people of Jammu and Kashmir. The petitioners have prayed to the court to declare the abrogation of Article 370 &35A as “void and in-operative”, Iqbal Tahir said in his statement.

Taking a strong exception to the statement of BJP leader Shahnawaz Hussain, Iqbal Tahir said that the Supreme Court has yet to decide on the petitions and yet a senior BJP leader is anticipating the verdict of the court. Such statements will not deter the resolve of the Peoples Alliance for Gupkar Declaration to achieve restoration of special status through political, legal and peaceful means.
