SRINAGAR, July 29: The High Court of Jammu & Kashmir and Ladakh has upheld the acquittal of a minibus driver accused of causing an accident involving a child, observing that the mere fact that a child was hit while suddenly crossing a road cannot, by itself, establish rash or negligent driving.
The court held that criminal liability in an accident case must be established through evidence showing that the driver acted rashly or negligently and that such conduct was responsible for the accident. The occurrence of an accident alone cannot lead to an automatic presumption of negligence.
The ruling came while dealing with a challenge to the acquittal of the driver by the trial court. The prosecution had alleged that the driver was responsible for the accident involving the child and sought to establish criminal liability on the basis of the circumstances surrounding the incident.
The High Court, however, found that the evidence on record did not establish the necessary ingredients of rash and negligent driving beyond reasonable doubt.
The court’s reasoning centred on the circumstances in which a pedestrian, particularly a child, suddenly enters the path of a moving vehicle. In such situations, the driver may have little or no opportunity to anticipate the movement or avoid the collision, depending on the circumstances.
The court made it clear that the finding does not mean drivers are free from responsibility when accidents involve pedestrians or children. Rather, prosecution must establish through reliable evidence that the driver failed to exercise the required care and caution.
The legal principle underlying offences relating to rash and negligent driving requires proof of a rash or negligent act and a direct connection between that conduct and the accident. The mere fact that an accident occurred is insufficient to establish criminal negligence.
The High Court consequently declined to interfere with the trial court’s decision to acquit the driver, finding no sufficient ground to overturn the acquittal.
The ruling reiterates the importance of distinguishing between an unfortunate road accident and an offence involving criminal negligence. While road users are expected to exercise due care, criminal conviction requires the prosecution to prove the accused’s culpable conduct in accordance with the standard of proof beyond reasonable doubt.
The judgment also highlights the evidentiary burden in road accident prosecutions. Factors such as the manner of driving, speed, road conditions, visibility, the position and movement of the pedestrian and whether the driver had a reasonable opportunity to avoid the collision can be relevant in determining negligence.
The High Court’s decision therefore reinforces that liability cannot be fixed merely because a vehicle was involved in an accident or because a pedestrian was struck.
The judgment provides an important legal reminder that each road accident case must be assessed on its own facts and evidence, with courts required to determine whether the prosecution has actually established rashness or negligence on the part of the driver.
By upholding the acquittal, the High Court has maintained the principle that an accused cannot be convicted on the basis of the occurrence of an accident alone and that criminal negligence must be proved through credible and legally sufficient evidence.
