Srinagar, August 17: The High Court of Jammu & Kashmir and Ladakh has intervened in a financial dispute involving a Kashmiri man who allegedly took a friendly loan to help facilitate his father’s Hajj pilgrimage and later failed to repay the amount, despite repeated requests from the lender.
The case came before the High Court after the borrower allegedly issued a cheque towards repayment but subsequently delayed its encashment until the cheque’s validity expired, leaving the lender without an effective means of recovering the money through the instrument.
According to the case details, the financial assistance was extended as a “friendly loan” to help the borrower meet expenses connected with his father’s Hajj. The lender later sought repayment of the amount, but the borrower allegedly failed to honour the commitment.
The dispute escalated when the borrower issued a cheque in favour of the lender. However, instead of ensuring that the cheque was honoured, the borrower allegedly stalled its presentation or encashment until the cheque became time-barred.
The lender subsequently approached the court seeking legal intervention and recovery of the money.
The High Court, while dealing with the matter, examined the circumstances surrounding the loan, the repayment instrument and the allegations concerning the cheque. The proceedings underline the legal consequences that can arise when financial transactions between individuals, even those based on personal trust, are not honoured.
The court’s intervention provides the lender an opportunity to pursue the claim in accordance with law, while the borrower will have the opportunity to respond to the allegations and contest the claim.
The case highlights the risks associated with informal financial arrangements and the importance of maintaining proper documentation and ensuring that repayment instruments are presented within their prescribed validity period.
The matter remains subject to further proceedings before the competent court.
