J&K govt seeks adjournment of Article 35A hearings in SC

New Delhi, Feb 11: Governor Administration has sought adjournment of the matter related to 35-A which was listed to be taken up during the current week.

The application of adjournment is moved before the Registrar General of Supreme Court by the State Government of Jammu and Kashmir through it’s Advocate On Record (AOR) M. Shoeb Alam.

Article 35A, which was incorporated in the Constitution by a 1954 Presidential Order, accords special rights and privileges to the citizens of Jammu and Kashmir and denies property rights to women who marry those from outside the state.

Confirming the development AOR M. Shoeb Alam told news agency CNS that he approached the Supreme Court seeking adjournment of the hearing on petitions challenging the validity of Article 35A of the Constitution in view that there is no elected government present in Jammu and Kashmir these days.

In a letter to the registrar of the Supreme Court and circulated, M Shoeb Alam, the standing counsel for the state in the apex court, sought adjournment of hearing on five petitions scheduled for Feb 12 to 14.

The state “will be seeking adjournment in the matters on account that since there is presently no elected government in the state of Jammu and Kashmir and the State is under President’s Rule. The present matter involves a sensitive issue regarding a challenge to Article 35A of the Constitution of India. A short reply has been filed by the State of Jammu and Kashmir in the lead matter (We The Citizens) and notices have not been issued in the other petitions. It will therefore be requested that the matter may kindly be heard when an elected government is in place,” reads the letter.
