Guardians Liable for Minors’ Offenses, Penalties Include Jail Time and Vehicle Impoundment : Transport Commisioner

Srinagar, July 12 : The Transport Department of Jammu & Kashmir is actively working to promote safety on the roads.
In a recent advisory of which a copy lies with Kashmir Despatch, transport commisioner J&K Rajinder Tara has urged parents and guardians to discourage their underage children from driving two-wheelers or four-wheelers.
He said that this advice aims to protect the lives of young drivers and safeguard pedestrians and fellow commuters.
According to Section 199A of the Motor Vehicles Act, 1988, the guardian or vehicle owner can be held responsible for any offense committed by a juvenile. However, the law also recognizes that guardians or vehicle owners may not be aware of their minor’s actions or have taken all necessary precautions to prevent such offenses. In such cases, they will not be subjected to punishment if they can prove their innocence.
Additionally, if found guilty, the guardian or owner may face imprisonment for up to three years and a fine of twenty-five thousand rupees. Furthermore, the registration of the vehicle used in the offense can be canceled for a duration of twelve months. The minor involved in the offense may also face fines and custodial sentences, with modifications implemented based on the Juvenile Justice Act, 2000 he said.
The order further reads to protect young drivers and ensure road safety, it is essential for parents and guardians to comply with these regulations. Juveniles should refrain from operating motor vehicles until they have reached the age of twenty-five or obtained the necessary licenses.
This advisory highlights the importance of responsible driving practices and encourages all members of the public, especially parents and guardians, to prioritize the safety of young drivers.
