J&K UT Govt approves prosecution against Malik, Asiya for raising anti-national slogans, advocating poll boycott

Srinagar, Dec 24 : The Government of Union Territory of Jammu & Kashmir has given a sanction for launching prosecution against jailed separatist leaders Muhammad Yasin Malik and Asiya Andrabi under the Unlawful Activities (Prevention) Act-1967 in two separate cases.

According to wire service— the Home department of J&K UT has given its go-ahead for prosecution of Malik and Asiya respectively in cases dating back to 2010 and 2018. Under the Unlawful Activities (Prevention) Act, government permission is mandatory for prosecution of an accused. Malik, chairman of banned JKLF, was booked under the law in 2010 for raising anti-national slogans at Sadder Koot Bala of Sumbal area of Bandipora.

“During the course of investigation, it was revealed that accused, chairman of banned JKLF, has raised anti-national and pro-freedom slogans at main chowk S.K.Bala in front of people who were coming out of Masjid after offering Friday prayers, thereby, causing hatred/ threat in the minds and hearts of people against the integrity and sovereignty of the country,” reads notification issued by the Home department on December 6, 2019.

The notification states that authority appointed by the government under Unlawful Activities (Prevention) Act has come to a conclusion that this is a fit case for accord of prosecution against the accused.

“…….In exercise of powers conferred by sub-section 2 of section 45 of Unlawful Activities( Prevention) Act , 1967, the government of Union Territory of Jammu and Kashmir hereby accords sanction for launching prosecution against the accused person namely Muhammad Yasin Malik S/O Ghulam Qadir Malik R/0 Maisuma Srinagar for commission of offences punishable under section 13 of Unlawful Activities Prevention Act 1967 in case FIR no.109/2010 of police station sumbal,” reads the notification.

In another notification, the government has accorded sanction for prosecution of Asiya Andrabi and her close associates Nahida Nasreebn and Fahmeeda Sofi for propagating and advocating boycott of Urban Local Body and Panchayat polls in 2018. An FIR (13/2018) was registered in police station Soura under Unlawful Activities (Prevention) Act for advocating election boycott.

The case was registered against them after police received information that Asiya and Fahmeeda are “resorting to unlawful activities by propagating /advocating election boycott of forthcoming ULB/Panchayat elections-2018, especially by inciting youth not to participate in these elections which results in creating disaffection towards India/ State of J&K and further supporting separatist elements who intend to bring about secession of State of J&K and disrupt the territorial integrity of India”. The investigation further revealed that Nahida Nasreen was also involved in the commission of crime, the notification states. (KNO)
