40 Flights with Tourists used to come in a single day to Kashmir from across world during Congress Govt : Azad

Lolab, April 03 : Congress Senior leader and Former Chief Minister of J&K on Wednesday said that during Congress government Kashmir had witnessed a peaceful and safe, developmental era with 40 flights with tourists were coming Kashmir across world in a single day.

Former Congress leader Ghulam Nabi Azad said that during the tenure of Congress led govermenrlt, Tourism sector had seen big growth with huge number of tourists coming everyday which helped the local hotelier, shikaras, Street Vendors and shopkeepers.

Azad while addressing an election rally in Lolab area of north Kashmir’s Kupwara said Kahsmir situation became worst soon after BJP came in Power and said only man responsible is Prime Minister Narendra Modi.

Futher Senior Congress leader Azad said that militancy is at peak in Kashmir this time with qualified youth are joining ranks, attacks on Army camps are increasing and blamed Prime Minister Narendra Modi as he couldn’t find a solution in political way.

Srinagar: PDP Chief Mehbooba Mufti on Wednesday said that if standing up for the rights of people makes her a separatist, then it is a badge she will wear with honour.

She was responding to the statement of Union Finance Minister Arun Jaitely who said that the statements of the mainstream politicians of the valley create a separatist psyche and is not acceptable to new India.

On the issue of the special status, both the PDP and the National Conference have been saying that if the Article 35-A is abrogated or removed, the relationship of the Kashmir with the Union of India will end.

India gets custody of 2017 CRPF camp attack plotter from UAE

India has secured the deportation of Nisar Ahmed Tantray, a Jaish-e-Mohammad militant and main conspirator behind the December 2017 attack on a CRPF camp at Lethpora in Jammu & Kashmir, from the UAE. Five security personnel were martyred in the attack during the intervening night of December 30 and 31, 2017, which ended with the killing of three Jaish militants.

Nisar Tantray, brother of Jaish divisional commander in South Kashmir Noor Tantray who earned fame as a “midget” militant being just four feet tall, was brought o Delhi by a special flight on Sunday and handed over to the NIA, which is probing the Lethpora case. Noor Tantray, said to have been instrumental in establishing Jaish in the Valley, was killed in an encounter in December 2017.

A warrant of arrest had been issued against deported militant Nisar Tantray by a special judge, NIA court, which facilitated his deportation. The UAE has been extending exemplary cooperation in deporting fugitives, including militants, in the past few years. They include AgustaWestland bribery case accused Christian Michel, alleged defence middleman Deepak Talwar, apart from several Islamic State sympathisers and militants, including senior Indian Mujahideen operative Abdul Wahid Siddibapa and 1993 Mumbai blasts accused Farooq Takla. Tantray is believed to have escaped to the UAE earlier this year.

This was just before another accused in the Lethpora case, Fayaz Ahmad Magray, a resident of Awantipora, Pulwama, was arrested in February. The three militants killed during the attack were identified as Fardeen Ahmed Khandey, a resident of Tral; Manzoor Baba, a resident of Drubgram, Pulwama; and a Pakistani militant namely Abdul Shakoor, a resident of Rawalakot area of PaK.

Fayaz, arrested by the NIA, was an active overground worker of Jaish and a key conspirator who provided logistical support such as providing shelter to terrorists.(TOI)

Forces launch search operation in Pulwama outskirts

Pulwama, April 03 : Government forces on Early Wednesday launched a cordon and search operation in South Kashmir’s Pulwama village.

Reports said a joint team of forces including Army, Police and CRPF jointly launched search operation in Gusoo area of South Kashmir’s Pulwama district and conducted house to house search operation in the area.

An official said following inputs about presence of some militants in the area search operation has been launched.

Searches in the area was on when last reports came in.

UAE Govt deports Jaish militant, NIA takes custody, starts questioning

The government has arrested a Jaish-e-Muhammad militant, Nisar Ahmed Tantray from UAE and handed him over to National Investigation Agency (NIA).

Sources told that Nisar who was absconding in Lethpora CRPF attack case of Dec 30, 2017, escaped to UAE on Feb 1, 2019. Nisar is younger brother of Jaish commander Noor Tantray.

Spokesman of NIA, Alok Mittal told KNO that Nisar was deported on Sunday by UAE government and they have taken his custody. “He is being questioned,” said Mital.

Jaish Militant Nisar Ahmed Tantray from Tral, Pulwama who was brought back to India from UAE today where he was hiding since last month after his accomplice was arrested in Kashmir. Nisar is involved in attack on CRPF in 2017. (KNO)

Crime Branch To Probe Major ‘JKPCC Scams’, FIR Registered

Srinagar : The Governor administration on Tuesday decided to hand over the investigation of “major scams” in Jammu & Kashmir Projects Construction Corp (JKPCC) to the Crime branch of JK Police. This is a major step towards eradication of corruption in the organisation, stopping and eliminating backdoor appointments and bringing in a culture of transparency, probity and efficiency in the organisation.

After receiving numerous complaints from many quarters about the functioning of JKPCC, particularly relating to corruption in civil contracts, illegality in appointments at multiple levels including at very senior positions, and excessive cost and time overruns, the government appointed a Fact Finding Committee to look into all these complaints. The Fact Finding Committee was chaired by the Principal Secretary (Planning), and had the Divisional Commissioner (Jammu), Commissioner/ secretary (revenue) and MD, JKPCC as members.

The mandate of the Committee was to look into: Manner of awarding contracts to contractors often on a nomination basis without following transparent tendering procedures; Diverting funds from one project to another leading to a large number of incomplete projects whose funds have been received but diverted elsewhere; Irregularities in appointments at various levels, including that of the Managing Director; Inefficiency in functioning and huge time and cost overruns in project implementation; Reasons for estimates for construction being much higher than those of PWD.

The Fact Finding Committee submitted a voluminous report bringing out in detail large irregularities in the operation of JKPCC. The Committee also gave recommendations on improving the organisation.

There are many elements in the findings and observations in the report which are quite alarming and a cause of serious concern. For an organisation which is over 50 years old, its operations seem to be riddled with ad-hoc functioning, absence of rules and a lack of systematic procedures. These have given rise to irregularities, which is a serious concern, and necessary measures for correcting these have to be taken to bring some order in the Corporation for its own health and long term welfare.

Keeping in view the seriousness of the matter and the findings of the Committee, the Government has decided on the following:

(a) Execution of Construction Works: The report clearly brings out that construction works have been executed by giving contracts on nomination basis, whereas JKPCC should have executed works in a departmental mode. This is a clear violation of a Government Order of November 2015 which was adopted by the Board of Directors in February, 2016. Irregular procedures in violation of government orders and BoD laid down SoPs are also noticed in engagement of consultants and nomination of piece workers. The Government has decided to hand over the investigation of all works executed or contracted out by the JKPCC after the issuance of the government order of November, 2015 to the Crime Branch of Police (Srinagar) to identify any irregularities in award of contracts in violation of prescribed SOP/procedures and take necessary action as per law. Based on the enquiry of the Crime Branch, further action against individuals will be taken.

(b)Irregularity in appointments including of MD: For an Organization which is in existence for the last 50 years, it has no Recruitment Rules. It is not clear whether there was adequate funding for this or whether this was done with proper authorisation/ competence. Further, the appointment of Mr. Vikar Mustafa Shonthu as Managing Director seems to have been done in clear violation of Government instructions and the Articles of Association of the Company. The appointment of the Chairman, any Director or the Managing Director is to be done by the Government, viz, either by the Cabinet or the Chief Minister in co-ordination. It appears that this appointment was done by the Chairman (who was the then Minister), who was not competent to do so. The appouintment was ab initio illegal.The Government has decided that the irregularity in the appointment of Mr. Vikar Mustafa Shonthu as Managing Director be referred to the Crime Branch of Police, Srinagar immediately for lodging an FIR and taking further action. Crime Branch would examine the role of the Chairman,the Board of Directors, the Administrative Secretary and the Company Secretary in this matter and take action as per law.

(c) The Fact Finding Committee will also look into all appointments made by JKPCC and ensure that all irregular appointments are terminated and action taken against those responsible. This will be done in three months, by 30.6.2019. Principal Secretary (Planning), as Chairman of the Committee shall oversee this entire process.

(d) Improving Control over JKPCC: In order to ensure that there is adequate oversight over the affairs of the corporation, a number of administrative steps will be taken including all powers of appointment to be removed from the Managing Director,the Administrative Secretary being made Vice Chairman of the Board, and all proposals made by the MD to the Chairman or to the Board to be routed through the Vice Chairman necessarily.

(e) Excessively High Estimates of JKPCC: JKPCC’s estimates should be either based on actual costs plus an overhead or based on PWDs Schedule of Rates which have an inbuilt overhead. The cost estimation procedure of JKPCC will be reformed through a Committee to be proposed by Administrative Secretary, PWD.

(f) Cost Overruns and Diversion of funds: The Committee reveals shocking details regarding diversion of funds by JKPCC from one project to another. This indicates poor control systems and absence of proper accounting procedures. The Committee also finds that there are large cost and time over-runs in projects. This is an indication of poor project management skills and weak controls. Government is taking steps to improve the controls and project management systems in JKPCC. (GNS)

Political gimmick but a reality!

Article 370, as it stands, assures Jammu & Kashmir a very special autonomous status in the Indian constitutional scheme. Owing to the special circumstances in which the former princely State was able to negotiate its accession to India, severe limitations were placed by the Constitution itself on the Centre’s powers vis-a-vis Jammu & Kashmir. However, over the years, a series of undemocratic measures and practices beginning with the 1954 Constitution Order eroded the rights and vital powers devolved by Article 370 on the State. The State Autonomy Commission Report and the resolution adopted by the Jammu & Kashmir Assembly in year 2000 represent a flamboyant attempt to reverse this situation, by pressing the demand that the State be returned to its pre-1953 constitutional status. The politics of the National Conference and Dr. Abdullah can justly be criticised for its opportunism, but there is absolutely nothing secessionist or extremist about it. Though it cannot be held that autonomy as demanded by the National Conference is the natural antidote to ‘extremist, secessionist and militant activities in the State’ but the re-institution and expansion of autonomy for the troubled State within the framework of Article 370 – on a freshly negotiated basis – is the democratic imperative.

It remains to be seen that whether the National Conference which has ruled the state for the maximum times, can live up to its promises and political slogans in times to come.

After GK, KR, Govt bans advts to Kashmir Uzma

Srinagar: Kashmir Editors Guild (KEG) regretted, yet again, that while it was expecting the lifting of the ban on government business to two major newspapers – The Greater Kashmir and Kashmir Reader, the government has added Kashmir Uzma to the list. The ban, as usual, is unexplained and implemented without conveying to the newspaper.

The ban, as we have conveyed earlier, is continuation of the onslaught that the Kashmir media has been subjected to, since 1989 in particular. The onslaught has led to the untold miseries to the institution of media and the shaking of the faith in the institution of democracy.

KEG that met on Tuesday discussed the fresh ban order has reiterated its stand that the ban is not only strangulating the media but is also impacting the idea of democracy. Interestingly, the ban came in the midst of the electoral process that is governed by the Moral Code of Conduct. The Information Department has not conveyed the ban formally.

NEW DELHI, Apr 2: NEW DELHI: Former Information Commissioner Sridhar Acharyulu has written to President Ram Nath Kovind against “conspiratorial attempt” of the government to “kill” the Central Information Commission through proposed committees under IAS officers to hear complaints against Information Commissioners.

Taking note of reports, Acharyulu said the proposed panels would reduce the CIC to the level of a “glorified clerk without glory”.

“I request the President of India to save RTI by insulating CIC from these kinds of onslaughts from the Government and their subordinate officers trying to prevent people from asking for embarrassing disclosures using RTI. This attempt is highly undemocratic, unconstitutional and smacks of high-level dictatorship and authoritarianism. This must be totally opposed,” he said.

Acharyulu termed the move to be against the Right to Information (RTI) Act, and violative of letter and spirit of the Constitution which gave independence to information tribunal. (AGENCIES)
