SRINAGAR, Dec 23: In a significant action against separatist networks operating from abroad, police have attached immovable property belonging to absconding accused Ghulam Nabi Shah alias “Dr Fai,” a US-based Kashmiri separatist, in Budgam district.
The action follows an application moved by Budgam Police, upon which the Special NIA Court, Budgam, ordered the attachment of the properties in connection with FIR No. 46/2020 registered at Police Station Budgam. The case has been filed under Sections 10, 13 and 39 of the Unlawful Activities (Prevention) Act (UAPA).
According to police, the attachment order was issued under Section 83 of the Criminal Procedure Code, which corresponds to Section 85 of the Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023. The court passed the order after the accused was declared a proclaimed offender by the competent court due to his continued evasion of the law.
In compliance with the court’s directions, two parcels of land have been ordered to be attached. These include land measuring one kanal and two marlas falling under Survey No. 466 at village Wadwan and another piece of land measuring 11 marlas under Survey No. 343 at village Chattabugh, both in Budgam district. The District Collector, Budgam, has been directed to take over possession of the attached properties as per legal procedure.
Police said investigations have established the involvement of the accused in various separatist activities, including the circulation and promotion of propaganda aimed at undermining the sovereignty and territorial integrity of the country. Keeping in view the gravity of the allegations, Budgam Police has initiated stringent legal action strictly in accordance with the law.
Reiterating its resolve, Budgam Police said it remains committed to taking firm and lawful action against individuals found involved in promoting or propagating separatist ideologies that are prejudicial to the unity, sovereignty and integrity of the nation. The action, police said, serves as a clear message to separatist elements operating from foreign soil that they will be dealt with strictly under the law of the land.
