SMC Ward Officer constructs house while paying two hoots to building laws and court order

Srinagar, Oct 05,: In just one day after the Commissioner Srinagar Municipal Corporation Gazanfar Ali told news agency that one of the known blue-eyed officer has been entrusted with the additional, but the most sensitive post of the enforcement officer, for the reason, that he has unmatched command’ over the ward officers, it has come to fore that the houses of a ward officer and his brother, being built without maintaining proper fire gaps, has been left untouched, with the result the neighbors were forced to seek an intervention from the court twice to stop the illegal construction.

According to the details, the said ward officer and his brother are brazenly violating the construction norms, for their under construction houses at Green Park Lane Hyderpora near Jamkash Lane, which according to the plaintiff is injustice with him.

Finding the ward officer taking the advantage of his position, intruding into his rights, approached the court of Municipal Magistrate in 2019 seeking its intervention to stop the illegal construction.

Subsequently on 10-07-2019 court issued an order directing the respondents to temporarily stop the construction work, till the matter is heard and the final verdict is issued.

The status quo according to the plaintiff Rafi Ahmed Haqqani continued till 27th September, when the Ward Officer and his brother resumed the construction work in violation of the court order, forcing him to once again approach the court to seek yet another intervention.

Hearing the fresh plea, court on 28th September issued a notice to Ward Officer and his brother, duly accompanied with a copy of the application for filing objections and in the meanwhile directed concerned Chief Enforcement Officer to implement the earlier order dated 10-0702019 on spot and furnish the report to the court by or before 06-10-2020, the next date of hearing.

Meanwhile, the applicant Rafi Ahmed Haqqani, while narrating his version to news gathering agency Kashmir Dot Com-(KDC), alleged that the said ward officer, encouraged by the patronage and looking another way by his superiors, is paying two hoots to the court order is continuing the construction work brazenly and without any fear of the law.

He said, “When we objected to the violation of the court order, we were attacked by the said officer, leaving us with no alternative, but to approach the police.”

“An FIR to this effect is also registered in Police Station Humhama,” he said.

Meanwhile, Commissioner SMC Gazzanfar Ali told KDC that he has ordered Joint Commissioner SMC to make an on-spot verification of the site and submit a report within a couple of days.

He said, “If the complaint is found true and any violation is found, appropriate action will be taken by the Corporation against it.”

“No one is above law and anyone violating the law will be sternly dealt with,” he said. (KDC)
