India’s New Law Closes Legal Loopholes

NEW DELHI, July 23: In a landmark move to strengthen public safety and plug long-standing legal gaps, the Government of India has officially recognized snatching as a specific and punishable criminal offence under the newly implemented Bharatiya Nyaya Sanhita, 2023. Section 304 of the BNS 2023 defines and criminalizes snatching for the first time in Indian legal history.
Previously, incidents of snatching were loosely clubbed under the broader categories of theft or robbery, leading to widespread confusion, inconsistent charges, and frequent legal loopholes. Police often struggled with how to categorize such offences, which led to a lack of clarity in prosecution and sentencing.
With the enforcement of the new criminal code, snatching—defined as the “forcible seizure or grabbing of movable property”—is now clearly established as a distinct criminal act. This legal clarity aims to improve the efficiency of investigations, ensure better conviction rates, and serve as a deterrent to offenders across the country.
Legal experts believe this change is a vital step in modernizing India’s criminal justice system. “The ambiguity is now gone. Law enforcement agencies can now act decisively, and victims can expect swift justice,” said a senior police official, while talking to the Kashmir Despatch.
The new classification is being hailed as part of broader reforms under BNS 2023 to streamline legal procedures and provide a stronger framework for public safety.
Authorities and civil society have welcomed the move, calling it “a step toward a safer and more just society.” The implementation of this provision is expected to reduce street crimes and instill a greater sense of security, especially in urban and semi-urban areas where snatching incidents have been on the rise.
The government has urged citizens to familiarize themselves with the new laws and has launched awareness campaigns using hashtags such as #NewCriminalLaw, #SnatchingIsACrime, and #LegalUpdate to spread the message.
As India transitions into a new legal era with BNS 2023, the clear criminalization of snatching marks a crucial milestone in the country’s pursuit of justice and rule of law.
