SC to hear Kashmir-linked petitions on Sept 16

0

New Delhi, Sep 5 The Supreme Court will examine on September 16 a batch of petitions, involving various issues, including relaxation of movement, in Jammu and Kashmir. The apex court decided this on Thursday while hearing petitions.

Kashmir Times Editor Anuradha Bhasin”s counsel told the Bench, headed by Chief Justice Ranjan Gogoi, that the media was not being allowed to function in the Valley for the last one month.

This was contested by Solicitor General Tushar Mehta, saying a number of newspapers were being published from Srinagar.

Activist Tehseen Poonawalla”s counsel submitted that people were unable to travel around freely, were being deprived of basic rights, and had no access to hospitals.

On this, Mehta said the people had access to hospitals and around 700,000 people had visited hospitals in the Valley.

Poonawalla has raised the issue of lockdown as amounting to suspension of Article 19 (freedom of speech) and Article 21 (personal liberty) of the Constitution.

When the court enquired Poonawalla about his vocation, the Attorney General said he appeared in television channels. However, Poonawalla”s counsel said he was an activist and had the right to appear anywhere to raise his voice against violation of human rights.

The court adjourned the matter and also tagged the petition of Mohammad Aleem Syed, a Jamia University law student. The law student in his affidavit detailed the situation in the Valley based on his visit.

Pak moves 2,000 soldiers within 30 kms of LoC

0

Pakistan has moved a brigade-sized force of around 2,000 soldiers to a location within 30 kms of the Line of Control (LoC) in Pakistan, Indian Army sources said on Thursday.

The troops have been placed in the Bagh and Kotli sector in PoK.

“The troop movement could be a defensive move by Pakistan in the light of heightened tensions with India. The movement and location was confirmed through various intelligence sources including local inputs,” said a senior Army official.

The security establishment is keeping a close tab on the troop movements in Pakistan and is exploring if it poses any immediate threat to India.

The move by the Pakistan Army assumes significance in light of the fact that Pakistan Prime Minister Imran Khan has threatened in the recent past of a war-like situation developing between the two countries after India withdrew special status for Jammu and Kashmir on August 5.
Pakistan has alleged human rights violations by Indian security forces in the valley and has also pledged to stand with the Kashmiris.

Defence Minister Rajnath Singh has on the other hand warned that India will not shy away from using its military strength for its defence and that the country’s adherence to a ‘no first use’ nuclear doctrine is subject to future circumstances.

Indian Army sources further said, quoting the confessions of two Lashkar-e-Taiba militants captured recently in Jammu and Kashmir, that around 300 trained militants are prepared to enter Indian territory from Pakistan.

“Militant groups, particularly the Lashkar-e-Taiba and the Jaish-e-Mohammed, are looking to recruit trained Afghan commanders into their fold. Afghans are being looked at because they are better trained and hardened. There has been a drop in the recruitment of local youth from the valley,” said the official.

He said a 25-member delegation of village heads and panchayat members from Jammu and Kashmir, including 13 from the Valley, held a one-and-a-half hour meeting with Union Home Minister Amit Shah in Delhi on September 3 and returned satisfied over the fulfilment of their various long-pending demands.

“Thousands of ‘sarpanches’ and ‘panches’ have no fear (of militants) and will play their role in restoration of peace and normalcy in Jammu and Kashmir,” Sharma told reporters here.

The Union home minister has assured them that every ‘panch’ and ‘sarpanch’ in Jammu and Kashmir vulnerable to threats from terrorists will get police security and insurance coverage of Rs 2 lakh each. Shah promised to begin recruitment for various government jobs at the earliest and said the government would ensure merit-based recruitment of at least five aspirants from each village.

He also told the delegation that the demand for increasing the honorarium of those holding the post of ‘sarpanch’ and ‘panch’ will be considered. Panchayat elections in the state were held last year after a gap of six years. More than 35,096 village heads and panchayat members were elected to 4,490 panchayats.

“Our delegation had a detailed discussion with the home minister over Panchayati Raj Institutions and the prevailing situation (in Jammu and Kashmir) following of the abrogation of provisions of Article 370… We are satisfied with the outcome of our meeting,” Sharma said. He said the main demands of the delegation included an employment package, security and insurance cover for ‘panch’ and ‘sarpanch’ facing threat to their lives and adequate funds at the disposal of each panchayat on par with MP or MLA local area development fund.

“Shah assured us that Rs 3,000 crore would be made available to panchayats across Jammu and Kashmir. Besides, four to five jobs will be given to each village in next couple of months besides accepting the demand for security and insurance coverage of the ‘panches’ and ‘sarpanches’,” Sharma said.

President Ram Nath Kovind has given his assent to a legislation in this matter. Sharma said the delegation also raised the demand for clearance of Rs 700 crore liability of MGNREGA, construction of new panchayat buildings at places where there is no such facility and deployment of security guards and gardners at each panchayat. He said all such measures are necessary to politically empower and strengthened the grass-root level institutions in Jammu and Kashmir.

Appeals Governor Satya Pal Malik and other top officials to put in place all arrangement for smooth processions across.

government is violating their religious rights under the excuse of law and order problem, In the heart of state capital Srinagar, the processions are not allowed along the traditional route –that begins from Abi Guzar, passes through Maisuma and ends at Zadibal. The 8th Muharram Procession was the largest procession of mourners being taken out traditionally in Srinagar led by senior leaders.

At contemporary our leaders are being detained, on the other hand, people want leaders to meet and hold consultations regarding preparations for the procession and other rituals. Syed Karar Hashmi said in a statement that, it is the responsibility of state apparatus to make smooth arrangements to facilitate procession as it is our fundamental right to practicing religion. Why strict restrictions are been placed, Police and paramilitary forces are been deployed, pedestrian as well as vehicular movement are barred and well placed razor fitted wire on the main roads of procession are been seen across on such days ? Need to place proper arrangements in place , so that processions will be peacefully organised across state.

The said ban has proved that so called themselves the lovers of peace have fake claims and weak theories in their pockets to befool the world community. Both Shia and Sunni Muslims are taking part on Muharram Procession and let revoking of ban give a clear message of peace in the valley. Hashmi added

Kashmir teen dies, police claim he was hit by stones, doctors say shell injury caused death

0

Srinagar: Asrar Wani, a 17-year-old boy who was battling for life at the intensive care unit of local Sher-i-Kashmir Institute of Medical Sciences (SKIMS) after sustaining injuries during a clash between local residents and forces last month, died in the early hours of Wednesday.

The authorities and the doctors who treated him, however, made contesting claims over the cause of Wani’s death, even as the law and order situation remained tense in downtown Srinagar.
Munir Khan, Additional Director General, Jammu and Kashmir Police, told reporters that Wani died of injuries caused by stone-pelting.

However, doctors who treated Wani confirmed that he died of a shell injury in his head that eventually led to a pulmonary cardiac arrest.

An SKIMS staff doctor looking after Wani’s case, however, refuted the authorities’ claims.

The cause of death is the head injury which led to a pulmonary cardiac arrest. A shell had hit his head causing grievous injury. He underwent a surgery and had been on the ventilator for long. He was improving but his condition worsened Tuesday night,” said the doctor who did not wish to be named.

A staff nurse at the ICU had earlier told ThePrint that Wani had sustained pellet injuries on his legs, chest, arms, left eye and face.
