Elections In J&K Futile, Benefits Those Who Want To Prolong Final K-Settlement: Bar

0

Srinagar, April 17 : Kashmir High Court Bar Association on Wednesday said that holding of elections in Jammu and Kashmir was a futile exercise and it has benefitted only those who are interested in the prolonging of the final and permanent resolution of Kashmir issue.

In a statement issued here, the lawyers’ body also expressed serious concern over the “deteriorating condition” of prisoners lodged in Central Jail here.

The inmates had gone on hunger strike for not allowing them to meet their kith and kin, who wanted to meet them but were not permitted to do so and also for not meeting their demand of withdrawal of the false and fictitious FIR registered against them with regard to the recent incident, the lawyers’ body said.

“The Bar Association demands that the relatives of the prisoners lodged in Central Jail, Srinagar and/or in other jail he allowed to meet them and the FIR registered against the prisoners lodged in Central Jail, Srinagar, by P/S Rainawari, Srinagar, on fictitious allegations be withdrawn and they be assured of a fair treatment while in jail, including their production in courts, where their cases are pending,” reads the statement issued here.It also reiterates its stand that holding of elections in the State was a futile exercise and it has benefitted only those who are interested in the prolonging of the final and permanent resolution of “Kashmir dispute”.

“Until Kashmir dispute is decided according to the aspirations and wishes of the people, there will be no peace in the sub-continent and the possibility of a war between India and Pakistan on the issue of Kashmir will loom large in the region.”

The Bar Association maintains that the United Nations Security Council in terms of its Resolution No. S/3779 dated 24.01.1957, while reminding the Govt. of Pakistan and India and the concerned authorities of the principle embodied in its resolutions of 21st of April, 1948; 3rd June, 1948’ 14th March, 1950 and 30th March, 1951 and the United Nations Commission for India and Pakistan resolutions of 13th August, 1948 and 5th January, 1949 has stated that the final disposition of the State of J&K will be made in accordance with the will of the people expressed through the democratic method of a free and impartial plebiscite conducted under the auspices of the United Nations.

“Any election held shall neither be a substitute for such plebiscite nor will it constitute a final disposition of the State in accordance with the principle. It is therefore imperative on both India and Pakistan to demilitarize the State of J&K and hold a plebiscite so that the people can decide about their future accordingly in a free, fair and impartial manner so that peace, tranquility, and prosperity of the people is ensured in every respect. “

The Bar Association also said that in terms of proviso added to Article 253 of the Indian Constitution the government of India has bound itself to hold plebiscite in the State of J&K, as such, it should abide by its own constitution and take steps to implement its terms by providing an opportunity to the people to decide about their future, in a free, fair and impartial plebiscite. 0

SRINAGAR, APR 17 : BJP party president Amit Shah said Wednesday Kashmir is an integral part of India and it would continue to remain so as long as the.

Shah’s remarks came at a poll rally, in response to National Conference leader Omar Abdullah’s recent suggestion of having a separate prime minister for Kashmir. “No one can take away Kashmir from us. As long as the BJP exists, Kashmir will continue to be an integral part of India,” Shah told the rally in western Maharashtra. “We will never allow two prime ministers in India,”

Shah said. The Congress wants to separate Kashmir from India, he added. Abdullah’s comment that Jammu and Kashmir bargained for a separate Prime Minister and President and hopefully they would have it, has also drawn a strong response from PM Narendra Modi, who demanded during a series of poll rallies that the Congress explain its ally’s comment.

Shah told the rally in western Maharashtra. “We will never allow two prime ministers in India,” Shah said.

“Prime Minister Narednra Modi worked to make the country safe. Through Balakot air strike, we avenged the deaths of our soldiers,” he said. “The chant of ‘Phir ek baar Modi sarkar’ is heard from all corners of the country now,” the BJP chief said. Shah also targeted the Congress-NCP combine which was in power in Maharashtra for 15 consecutive years till 2014, when the BJP wrested power from it.

PC worker cajoles voters with ‘cash for vote’ cue

SRINAGAR, APR 17 : The ‘vote-buying’ episodes of this election season have resurrected, just a day before the second phase of Lok Sabha elections this time all the way from Srinagar, from a leader of Sajjad Lone’s Jammu and Kashmir People’s Conference (JKPC) party.

Latif Mir, the JKPC leader could be seen through the hidden camera, coaxing people and brazenly putting a price on their votes.

He said, “Whether you go to Paris, London, France, Germany or America, you must know, I am the real friend of people living in the valley. I have an attachment with this place. This border is mine…And sometimes I take off planes from here…Let others also speak and put forth their point of view.”

“If you want money, I will give but if I tell you tomorrow that you paid me Rs. 300 for a vote, I promise even if someone doesn’t vote, my relation with him will not end. If you call me in the night, I can come for you even at 1 in the night. I am not away from you. There is an official record that I have never locked my door since 1989. I will settle your issues,” he added.  (PTK)

Pakistan very important role to play in overall dynamics of issue of Kashmir: Mehbooba Mufti

0

SRINAGAR, APR 17 : Former Jammu and Kashmir chief minister and Peoples’ Democratic Party (PDP) president Mehbooba Mufti said that the issue of Kashmir is both political and emotional in nature.

Mehbooba Mufti said that any pragmatic and lasting solution needs India and Pakistan sitting together on a table and discussing a solution that addresses the aspirations of the Kashmiris and does not compromise the territorial integrity of either India or Pakistan newslinemagazine reported.

She added “Dialogue and engagement gives you an opportunity to offer a better idea to replace an existing one. For all pragmatic purposes, the foundations of solution are confidence-building measures and engagement, both internally and externally”.

“Not only should Jammu & Kashmir be opened up for the rest of the world through all our traditional routes to China, Central Asia and other geographical locations, but there should also be a sense of unification between the two sides of Kashmir wherein, without changing borders, they are made into a single unit for all practical purposes” Mufti added.

Mehbooba further added that the best explained by the indicator that when Vajpayee and Musharraf engaged in dialogue, that period saw a sharp decline both in infiltration from across the LoC, as well as militancy at large.

It is also a fact that in the absence of any credible forward movement in the dialogue process to resolve the issue of Kashmir, a sense of hopelessness creeps into the youth of the state, which in many cases leads them to take the extreme path of violence.

Mehbooba added that In any case, with the recent confrontation between India and Pakistan, there is hardly anything left to internationalise the issue of Kashmir any further. For resolving the issue, the bottom line remains that the governments of India and Pakistan need to sit and discuss the issue and try and solve the problem, taking the people of the state on board.

Mehbooba added “I am a democrat and I believe that the beauty of democracy is that it can accommodate varied ideas and points of view. In the complex case of Jammu & Kashmir, the Hurriyat and other separatist parties too represent a sentiment and point of view. Without getting into how many people they represent, it is important to accept the existence of such points of view, even if one doesn’t agree with them. Any meaningful engagement would entail discussions with the separatist leadership, and no framework for the resolution of the state of Jammu & Kashmir can have legitimacy without taking such representatives and sentiments on board for discussion.

She added Pakistan has a very important role to play in the overall dynamics of the issue of Jammu & Kashmir. No framework that doesn’t take Pakistan into consideration and account for its importance, would ever be practical and result-oriented. That is what guides the positioning of Pakistan in my politics and my conversations with the electorate. (PTK)
