4 Medical Officers Fail To Join New Postings More Than Fortnight After Transfer

0

More than a fortnight after government ordered their transfer, four medical officers has failed to join new postings.
One of them, Dr Firdous Ahmad Bhat, had even challenged the transfer order (No. 266-HME of 2019 dated 1st of Mach, 2019), whereby he has been transferred as I/C BMO, Sogam and posted as Medical Officer, SDH, Langate.

The other doctors include Dr Reyaz War (Medical Officer) District Officer Baramulla who has been transferred and posted as Incharge BMO Sogam vice Dr Firdous Ahmad Bhat, Dr Gowhar Nabi (Medical Officer) Pulwama— transferred and posted as Incharge BMO Langate—and Dr Nazir Ahmad Bhat (Medical Officer) Incharge BMO Langate who has been transferred as Medical officer SDH Sogam.

The four medical officers were transferred along with 58 others on March 1 vide Government Order No: 266-HME of 2019.
The high court while disposing of the petition filed by Dr Firdous Ahmad Bhat had directed him to file a detailed representation before government, seeking redressal of his grievances with reference to his posting as Medical Officer, SDH Langate within one week.

Upon receipt of such representation, the high court ordered government to accord consideration to the same in accordance with the law and the rules governing the field within two weeks, thereafter.
“The petitioner (Dr Firdous) may, on his part, make available all the relevant documents before the competent authority so as to substantiate his claim for posting as BMO.”

The court had also reiterated that it was well settled position of law that transfer/ posting of a Government employee is an exigency of service and is the sole prerogative of the Executive.

“Ordinarily, the Courts are not interfering with the policy of the Government directing posting/ transfers of the Government employees, but, in exceptional cases, where the transfer/posting is made by an incompetent authority or is against rules or is a result of malafides, the Courts do interfere,” the court said, adding, “No such ground is available to the present petitioner. However, if the petitioner has any grievance with reference to his posting, he can approach the authorities concerned for seeking redressal of his grievances as the Courts cannot issue any mandamus directing the authorities to transfer/place or not to transfer/ place a Government employee at a particular place.”

However, the court had ordered Dr Firdous’s claim, being senior and entitled for adjustment as BMO, also needs to be considered by the government.
Director Health Service Kashmir Dr Kunzes Dolma when contacted told news agency that she will look into it and action under rules will be taken accordingly.

“Since you have brought the issue into my notice and seek the report from concerned,” she said, adding, “Action as per the rules governing the field would be taken accordingly.” (GNS)

Duty of every Kashmiri to remain steadfast, follow every JRL program: JRL

Srinagar

Joint Resistance Leadership (JRL) in a joint press release issued to media on Monday said that “manoeuvres” to trample a peoples resistance through NIA, ED like agencies, PSA and Unlawful acts, banning socio /religious organizations, arresting common people, political activists, Ulema and religious scholars, and other acts are like daydreaming. It is the duty of every Kashmiri to remain steadfast, follow every program from leadership in letter and spirit and keep the flame of freedom lit.

The spokesman while terming the ongoing and unabated violence in Kashmir valley and Muslim dominated areas of Jammu as a result of colonial mindset of rulers, the Joint Resistance Leadership (JRL) comprising of APHC (G) chairman Syed Ali Shah Geelani, APHC (M) chairman Mirwaiz Muhammad Umar Farooq and Jammu Kashmir Liberation Front (JKLF) said that human history bears a witness to the fact that suppressing peoples movements through “military and police force” is not possible and such dreams always prove dreams without interpretation that never come true.

Naming NIA, ED warrants and summons against Mirwaiz Muhammad Umar Farooq, Syed Naseem Geelani and others as part of ‘operation all out’ and undemocratic acts, JRL said that framing concocted charges by using NIA, ED like agencies and then intimidating leaders, their children, kith and kin and friends under this garb is ample proof of failure to defeat Kashmiri resistance and this is what has prompted rulers to start a new revengeful violence against Kashmiris, the statement reads.

JRL said that summoning Mirwaiz Muhammad Umar Farooq, Syed Naseem Geelani and other to Delhi by NIA and ED is also aimed at fooling the public to garner more and more votes and seats in upcoming elections which too is a condemnable act.

Deploring the arrest of JKLF chairman, one of the pillars of JRL, Muhammad Yasin Malik , Spokesman of Jamat-I-Islami Advocate Zahid Ali, vice president of Jamiat Ahlihadees Molvi Mushtaq Ahmad Veeri and hundreds of others and implementation of PSA on them, reopening some “concocted” cases on Yasin Malik, JRL said that this arrest spree is also part of operation all out  and Kashmiris have been bearing this kind of violence from 70 plus years now.

Leadership said that veteran ailing leader Syed Ali Shah Geelani has been placed under house arrest from last many years and Mirwaiz Muhammad Umar Farooq and others are also often caged like this and the main purpose of these confinements is to stop leadership from meeting masses.  JRL also termed the dossier that has been framed against JRL leader Muhammad Yasin Malik absurd. The leadership also condemned the ban on Jama’at and arrest of its leaders and activists.
