SRINAGAR, June 18: Seven days after his arrest, YouTuber Faisal Wani who had uploaded a video depicting the beheading of suspended BJP Spokesperson Nupur Sharma, has been granted bail by the Judicial Magistrate (First Class), Srinagar.
Nupur Sharma was earlier suspended by the BJP for her controversial remarks against Prophet Muhammad (SAW) on a TV debate, which triggered a massive outrage globally.
The YouTuber Faisal Wani was booked by the J&K Police under various Sections of the Indian Penal Code after the said video went viral on social media. Wani was arrested on June, 11 after which he moved a bail application through his Advocates Viqas Malik and Muneeb Romaan.
It was argued on behalf of Wani that his further detention in the case will be unjust especially because custodial interrogation is unwarranted.
Reference was also drawn to the judgment of the Supreme Court in Arnesh Kumar’s case, which had cautioned police forces across the country against effectuating arbitrary and mechanical arrests.
The City Court while granting bail to Wani on a bond of ₹20,000/- observed that “Bail is the rule and Jail is an exception”.
