Poonch parts shuts ahead of Supreme Court hearing on Article 35A

Jammu, Feb 25 : Mandi town of Poonch in Jammu region on Monday shuts against any attempts to scrap Article 35A in view of tomorrow’s hearing in Supreme Court.


The shops, business establishments, petrol pumps and educational institutions in the area are closed , The public and private transport is also off the roads. Only security force vehicles and some two-wheelers are plying on roads in the area.


The traders and members of religious bodies in Mandi have called for shutdown in favour of Article 35-A. The transporters from the area had also extended their support to the shutdown call and announced that no private passenger vehicle will ply on Monday.

SRINAGAR: Uneasy suspense in Kashmir Valley continues as people are storing essential items fearing backlash from the authorities in wake of the Pulwama attack earlier this month in which 40 CRPF personnel were killed. 

Former chief minister of J&K and National Conference leader Omar Abdullah, informed that his father and party president Dr Farooq Abdullah spoke to Union Home Minister Rajnath Singh and briefed about the sense of panic prevailing in the Valley. He has requested the NDA government to step in with a statement and steps that reassure people. 

“Dr Farooq Abdullah briefed Home Minister about the panic buying in the markets and the way petrol pumps have run dry and how speculation about possible developments has worsened an already tense situation,” he tweeted. 

The government orders from different departments carrying special directions regarding storage of medicine, food stocks cancellations of leaves of doctors has added to the rumors of possibility of massive law and order situation in the Valley. The shortage of fuel administration has clarified is due to closure of Srinagar-Jammu highway. However, people say that the authorities are misleading them and trying to divert the attention. 

“They can scrap article 35 (A), declare emergency in the state or launch bigger crackdowns and encounters not only against militants but the whole population,” a 65-year-old, retired government servant, who bought 100kgs of rice and other essential items from a grocery store in Khayam area of Srinagar. 

Senior police official and bureaucrats also run wild guesses on what could be the plan, but are sure that something specific and big is in offing. 

“We don’t know exactly what but something big is going to happen. We detained some people who have no idea why they have been detained, as the orders came directly from Delhi,” a senior police official told. He said that it is war like situation, where lower rung officials are just executing the orders and know nothing what is the grand plan. The armed forces have already tightened noose in the Valley after Pulwama attacks and scores of youngsters have been detained after February 14. 

Even pro-elections politicians are tweeting since morning urging New Delhi and administration to clarify what is going on. 

“We are putting on the table every possibility. Even J&K might be declared a Union Territory or there might be trifurcation of state or simply New Delhi create an example out of the Hurriyat and Jamaat carder,” a former legislator, wishing not to be named told. He went on to saying that special status of the state might be abrogated so that BJP will satisfy its electorate ahead of the elections.

Sensex jumps over 100 pts, Nifty above 10,800 level

Mumbai, Feb 25 (PTI) Stocks staged a strong comeback in early trade Monday, with the BSE Sensex reclaiming the 36,000-mark by surging over 100 points on heavy foreign fund inflows and increased buying by domestic institutional investors.

Asian markets were also trading in the green after US President Donald Trump announced extension of the March 1 deadline for increasing tariff on import of Chinese products, as talks between the two sides were making “substantial progress”.

The 30-share Sensex rose 140.29 points, or 0.38 per cent, to 36,011.77 in early trade. The gauge had lost 26.87 points Friday.

The broad-based NSE Nifty also rose 32.50 points, or 0.30 per cent, to 10,824.15.

Major gainers that supported the recovery on both bourses were Tata Steel, Tata Motors, Vedanta, RIL, HDFC Bank, Infosys, TCS, M&M, Hero MotoCorp IndusInd Bank, Maruti Suzuki, HCL Tech, Bajaj Auto, HDFC, HUL and Sun Pharma, rising up to 1.13 per cent.

Sentiments also got a boost after the GST Council Sunday slashed tax rates on under-construction housing properties to 5 per cent without input tax credit, from the existing 12 per cent, brokers said.

Stocks of realty and housing finance companies were back in better form and scored handsome gains.

Sectoral indices, led by realty, IT, auto, bankex and consumer durables, were trading in the green with gains of up to 2.16 per cent.

While oil and gas, PSU, capital goods and power sector indices were trading lower.

Brokers said heavy foreign fund inflows and buying by domestic institutional investors (DIIs) amid a firm trend at other Asian bourses led the markets higher.

Foreign portfolio investors (FPIs) bought shares worth a net Rs 6,311.01 crore, while DIIs made purchases of Rs 838.88 crore on Friday, provisional data showed.

Elsewhere in Asia, Shanghai Composite Index climbed 3.32 per cent, Japan’s Nikkei was up 0.68 per cent, Hong Kong’s Hang Seng rose 0.32 per cent in their early deals. Taiwan index too gained 0.39 per cent.

Meanwhile, the US Dow Jones Industrial Average ended 0.70 per cent higher in Friday’s trade.

Forces launch search operation in Hajjin

Hajjin, Feb 25 : Government forces on Monday morning launched a cordon-and-search operation in North Kashmir’s Bandipora village.

Reports said that a joint team of army’s 13 RR, CRPF, and SOG laid a siege at Mir Mohalla area of Hajjin on Monday morning .

A police officer also confirmed the incident and said that the cordon was launched following inputs about the movement of some suspected militants.

Local reports said that door to door search operation has been conducted by team of forces.

When last reports came in search operation in the area was on.

J&K Yet To Define Stand On Article 35A; SC Hearing Soon

With the hearing on the constitutional validity of Article 35A at the Supreme Court likely this week, the Jammu and Kashmir government is yet to decide its stand. It is the first time that hearing will be held on the provision when the state is under the Governor’s rule.
Advocate General of Jammu and Kashmir D.C. Raina told IANS on Sunday they would discuss the position and finalise the stand in a day or two.

Speaking from Jammu, Raina said the matter was with the Law Department and without their instruction, he cannot spell out the stand. The matter is on board for quite some time but did not reach the hearing stage earlier, he said, adding they expect it to come up for hearing on Wednesday or Thursday.
However, the Jammu and Kashmir government submitted to the apex court about three weeks ago, seeking adjournment on the grounds the issue involved is sensitive, and there is no elected government in the state.

The last hearing took place on August 31, 2018. The matter was adjourned to the second week of January as Attorney General K.K. Venugopal pleaded postponement on the grounds of panchayat polls in the state.

Article 35A was incorporated in the Constitution by the 1954 Presidential order which conferred special rights including government employment, acquisition of immovable property, settlement in the state, grant of scholarship and any such form of aid to the permanent residents of Jammu and Kashmir by the state government.

To guarantee these special rights and privileges, the 1954 Presidential order said no existing law in force in Jammu and Kashmir, or that enacted by the state legislature in respect of the special rights and privileges of the permanent residents “shall be void on the grounds that it is inconsistent with or takes away or abridges any rights conferred on the other citizens of India by any provision of this part (III)”.
In the past, the President’s power to issue orders taking recourse of Article 370(1) were unsuccessfully challenged twice before the Supreme Court.

The first time the President’s powers to issue orders in respect of Jammu and Kashmir was upheld on March 30, 1961 by a five-judge Bench, comprising Justice K.N. Wanchoo, Justice P.B. Gajendragadkar, Justice A.K. Sarkar, Justice K.C. Das Gupta and Justice N. Rajagopal Ayyangar.

Addressing the challenge to the Presidential order introducing indirect election to the six Lok Sabha seats from the state, the court said: “Article 370 clearly recognises the special position of the State of Jammu and Kashmir and that is why the President is given the power to apply the provisions of the Constitution to that state subject to such exceptions and modifications as the President may by order specify.”

The apex court had in 1961 also stated: “We are therefore of the opinion that the President has the power to make the modification, which he did in Article 81 of the Constitution. ”
Article 81 provides for the composition of the Lok Sabha.

The Supreme Court Bench, comprising then Chief Justice M. Hidayatullah, Justice Vashishtha Bhargava, Justice J.M. Shelat, Justice G.K. Mitter and C. A. Vaidyalingam, by its October 10, 1968 judgment had said the “Article 370 of the Constitution has never ceased to be operative and there can be no challenge on this ground to the validity of the orders passed by the President in exercise of the powers conferred by this Article.”(IANS)

Article 35A row: Stay home in case of ‘mass agitation,’ Naikoo warns cops

Srinagar, Feb 24: Hizbul Mujahideen commander Riyaz Naikoo Sunday said policemen should “stay home” and not try to “suppress any mass agitation by people” if Article 35A is scrapped.

“People who work in the police department must understand that Article 35A is as important for them as it is for common Kashmiris. We are not asking you to resign, but just stay home like other government employees when we ask you to,” he said, warning cops of dire consequences if they fail to do so.

He also asked non-local residents to leave Kashmir if “ India does anything with Article 35A.”

“The situation indicates that India is planning to tinker with Article 35 A and is sending more troops to suppress people and deprive them of leadership by mass arresting resistance leadership. We must also bear in mind that previous agitations were called off keeping in view the educational loss of our children. But we must ask ourselves about the future of our youth who were blinded , booked under PSA or thrown out of educational institutions in India . Therefore we must make up our mind for sacrifices once and for all,” Naikoo is heard saying in a purported audio clip, that has now gone viral on social media.

“India is mistaken if it thinks it can suppress the movement by arresting the leadership. We appeal people to stay united . Religious organisations must not fall prey to trivial sectarian disputes,” he said.

“India does not consider us human beings as their leaders have made clear through their recent statements that they are only interested in Kashmir’s land and not its people,” he said.

Naikoo said Kashmiri students who were thrashed outside were targeted for “being Kashmiris and not for their religious school of thought. Even those whose fathers and brothers work for the Indian army and police were not spared. India does not need any of us. If today someone else was attacked, tomorrow it will be you .”

Kashmir shuts against mass arrests

SRINAGAR, FEB 24 : Kashmir valley observed a complete shutdown on Sunday on Hurriyat call against the fresh arrest spree.

Reports said that authorities imposed restrictions in Srinagar areas on Sunday to thwart any protest against the arrests of Jamaat and Hurriyat leaders on Friday night.

The shutdown was called by Joint Resistance Leadership (JRL) comprising Syed Ali Geelani, Mirwaiz Umar Farooq and Muhammad Yasin Malik ahead of hearing on Article 35-A.
All the shops, business establishments and petrol pumps were closed while as traffic was also off the roads throughout the day. The traffic movement also remained suspended.

News agency has posted that arrest of JKLF chairman Muhammad Yasin Malik, Jamaat-e-Islami chief Dr Mohammad Fayaz and a dozens of Jamaat activists on Saturday trigerred clashes in several parts of Srinagar city and other parts of Kashmir Valley. The arrests of Yasin Malik and Jamaat cadres evoked serious criticism and condemnation from both separatist and mainstream leaders including Syed Ali Shah Geelani, Mirwaiz Umar Farooq, former chief ministers Mehbooba Mufti and Omar Abdullah, PC chairman Sajad Gani Lone, PDF chairman Hakim Mohammad Yaseen, CPI (M) leader Mohammad Yousuf Tarigami and DPN president Ghulam Hassan Mir.

Present prevailing situation in Kashmir ‘serious, explosive’: Hurriyat (M)

Srinagar, Feb 24 : Hurriyat Conference (M) termed the present prevailing situation in Kashmir as ‘serious and explosive’, stating that “to strengthen its grip of illegal occupation all international principles are being violated while forces have been given a free hand to instill fear and create a suffocating atmosphere across the Valley leaving people in shock and despair.”
Hurriyat (M) warned of any tinkering with the State’s hereditary State subject law, Article 35 A stating the move aimed at tampering with the law is fraught with dangerous consequences as the people of all the three regions of the state are united and stand together and will not allow any change in it at any cost.
The statement strongly denounced the crackdown, mass arrests and continued nocturnal raids across Kashmir and condemned the arrest of resistance leaders Muhammad Yasin Malik, Ameer-e-Jamaaat Dr Hameed Fayaz and dozens of other Jamaat leaders and also the arrest of Jamiat-e-Ahlihadees Vice President Moulana Mushtaq Ahmeed Veeri and dozens of other activists of Jamiat-e-Ahlidhaees Moalana Maqbool Akhrani and the arrest of Hurriyat leaders and activists.
“By resorting to arbitrary and illegal arrests, detentions intimidation and restrictions the rulers will not achieve anything as in the past, nor will it force the people of Kashmir into submission,” Hurriyat (M) said, while condemning the house arrest of its former chairman Prof Abdul Ghani Bhat.
Hurriyat (M) also termed the crackdown and mass arrests of resistance and socio religious leaders across Kashmir as vindictiveness of the government and stated that “these repressive measures aimed at instilling fear among the common masses and among those peacefully pursuing their struggle for resolution of the Kashmir dispute by addressing people will and aspirations will not make them give up.”
Hurriyat (M) reiterated that the lingering Kashmir dispute was the main reason of tension between the two nuclear powers, India and Pakistan and that as long as the issues remains unresolved, there will always be mistrust and threats of war always will loom over the region and peace would always be elusive.
It said that Kashmir issue was not a territorial dispute between the two nations but an issues of justice related to political fate of more than a crore people living in this land and it was high time that the issue be resolved in its historic perspective and keeping in view the aspirations of its people.

Man kills girlfriend before committing suicide in Jammu

A 24-year-old man allegedly killed his girlfriend before committing suicide inside his house, police said Sunday.

Rakesh Kumar (24) and Shalu Devi (25), both neighbours, were found dead inside the house at Bishnah on Saturday, they said.

Kumar’s body was found hanging from the ceiling of his room, while the body of the woman was lying nearby with stab injuries, police said. 

Preliminary investigation suggests that the two were in a relationship and had a scuffle over some issue following which Kumar stabbed the woman before hanging himself, police said.

The man used to work as a salesman at a shop in the locality. 

Policehave registered a case and further investigation is underway.
