No changes being made to status of J&K bank: Governor

Srinagar, Dec 4, CNS: Governor Jammu and Kashmir Satya Pal Malik on Tuesday said that J&K Bank is registered as a Government Company under the Companies Act. The word PSU has no legal connotation, and the bank will continue to be a Government Owned company. He said no new changes are being made in the status of Jammu and Kashmir Bank.

The spokesman said that Governor Malik addressed a delegation of employees of J&K Bank.

He said, during the meeting Governor said that J&K Bank is a premier institution of the state and its financial health and future growth is of utmost importance to Jammu and Kashmir. Therefore, the Government would support all initiatives and take the necessary steps to make the J&K Banka vibrant Institution.

The spokesman said that employees should not be concerned about their employment, future prospects or salary structure under any circumstances.  The Board of the bank is competent to take decisions in this regard and the powers vest in the Board. No changes are being contemplated on this front.

As far as the Public Sector Undertaking (PSU) matter is concerned, the J&K Bank is regulated (i) by RBI as an old generation private sector bank, (ii) by the Registrar of Companies as it is a Government Company under Companies Act and (iii) by SEBI as it is a listed company. It will continue to be regulated by the RBI, SEBI and the Registrar of Companies. No changes are being made here or contemplated.

As a Government Company, J&K Bank is a Public Authority under the Right to Information Act (RTI) and hence is automatically subject to the transparency provisions of RTI.  Nothing new is being imposed in this regard. Transparency is good for the bank in the long term.

As far as the accountability to the legislature is concerned, all Government Owned/Controlled Companies, including J&K Bank which is registered as a Government Company, are accountable to the legislature in some respect. This is what has been stated in the SAC decision. This does not add any new element.  However, in view of the concerns expressed, and to give comfort to employees, the government will re-examine the issue of accountability to the legislature.

Finally, the Board of the Bank is the appropriate forum for taking and implementing all decisions of J&K Bank. Safeguarding the autonomy and operational independence of the bank is a key objective of the government at all times. (CNS)

Despite Article 35A in vogue, IMPA invites non-state subjects to apply for jobs in Jammu and Kashmir

Srinagar, Dec 4, CNS: Article 35A is existing in Jammu and Kashmir by name. One of the provisions of this article which prohibits outsiders from seeking jobs in Jammu and Kashmir was virtually trampled under by the then Governor Administration in 1992 when recruitment rules were framed in the Institute of Management, Public Administration allowing non-state subjects to seek jobs on permanent basis.

    The Jammu & Kashmir Institute of Management, Public Administration and Rural Development (IMPA) which is an autonomous Society under the aegis of the State Government has invited applications from the posts of Professors, Assistant Professors and Associate Professors on All India basis. The irony is that non-state subjects can now be appointed on permanent basis in IMPA-which is completely funded by Jammu and Kashmir Government. IMPA is an autonomous body that is registered under Society Act. This Institution is funded by Government of Jammu and Kashmir and in no way can appoint non-state subjects that too are permanent basis.

   Reliable sources told news agency CNS that when militancy was at its peak and there was complete chaos in 1992, the then Governor Jagmohan amended the recruitment rules of IMPA and under new recruitment rules, non-state subjects were also allowed to seek jobs in the Institution.

   “These recruitment rules of IMPA allow candidates from other states to seek employment as faculty. Who made these recruitment rules and had they taken Article 35 A into consideration. Don’t you think it violates Article 35A. Is it not the right time to stop and scrap this recruitment policy? When these recruitment rules of IMPA were framed, was the committee competent to allow non State subjects to apply for faculty positions keeping in view the Article 35 A which does not allow this.,” says Journalist Rift Abdullah.

    “Why Omar Abdullah and Mehbooba Mufti are silent on such issues, because they have also carried forward such violations. Erosion of 35A and 370 has happened like this over the period of time but it should not be precedence. We must rectify it,” he adds.

   This institute was created for in-service training to the State Government employees as also to undertake research and consultancy in areas of crucial importance to the administration of the State.

   An employee who wished not to be named said that faculty till date was unaware of this fact that IMPA can avail the services of non-state subjects on permanent basis. “Now you will have non- state subjects as faculty and it is a serious issue,” he said.

    Renowned lawyer Sheikh Shakil said that it is the institution owned by State Government and it is the obligation of Government to advertise posts on state basis. “Jammu Kashmir occupies a unique position and you can’t bring faculty or provide jobs to non-state subjects. This is total violation of law,” he added.

   Efforts to contact Director General IMPA on this issue didn’t materialize.

   However, Director Training Mushtaq Ahmed Khan told CNS that IMPA is also funded by National Institute of Rural Development and keeping in view the new recruitment rules, non-state subjects can get jobs. When asked is there any non-state subject who is a faculty member in IMPA at present, “No,” he replied. (CNS)

The owner of the business chain Altaf Hussian Najar hails from Batpora Sopore North Kashmir area of Baramulla district is a graduate and worked as a web designer for six years in Srinagar. Altaf belongs to a poor family and have seen all kinds of hardships in his life. He had to let go his desires and wishes because of limited earning of the family.
“I completed my graduation when i was 22, and responsibilities of my parents and family came over my shoulders, i started working as a web designer at srinagar office. But i was never satisfied. The payment was not even able to fullfil the basic amenities of my family. I worked for six years , but the hunger of success was rolling in my head, I had to fulfill all my wishes which I couldn’t due to limited money” he said.
JKEDI , A Platform for the youngsters to lead as an entrepreneur helped Altaf Hussian Najar to look for a brighter side of his carrier. Today ,Altaf is not only an owner of the company but feeding 5 other families too.
“One of my friend advised to apply for JKEDI , where I could get an easy loan to start a new business. And the idea hit my mind. I went to Baramulla JKEDI office and met JKEDI officer Waseem Ahad. He supported and instructed me in the procedure of the Entrepreneur loan. It’s a blessing for all the youngsters looking for loans, for their business or want to start a business of their own” Altaf added .
Despite of all the odds and the pressure of a volatile area of Sopore, Altaf Hussian najar showed his courage, and determination to work with the help of JKEDI. He proved that dreams are meant to be fulfilled if it is done with dedication.

Panchayat Polls-2018: Voting to take place at 2714 polling stations in Phase-VII

JAMMU, DECEMBER 03: Voting for Phase-VII of Panchayat Polls-2018 will be held tomorrow at 2714 polling stations across the State including 576 in Kashmir division and 2138 in Jammu division. The timing for polling is from 8 am to 2 pm.

According to the Chief Electoral Officer, J&K, Shaleen Kabra, 892 polling stations have been categorized as hypersensitive in this Phase including 428 in Kashmir division and 464 in Jammu division.

He said 5575 candidates in the fray for 341 Sarpanch and 1798 Panch seats in Phase-VII, while 85 Sarpanchs and 912 Panchs have been elected unopposed in this phase.

He said in the areas going to polls in Phase-VII, an electorate of 475865 will be voting for Sarpanch constituencies and 345880 for Panch constituencies. “Photo Voter Slips have been distributed among the voters to inform them of their polling station,” he said.

CEO said at the end of 6 Phases of Panchayat Polls, overall voter turnout of 73.6% has been recorded across the State, with a poll percentage of 46.1% in the Kashmir division and 82.8% in the Jammu division for the first 6 phases.

Kabra said in Phase-VI of Panchayat Polls held on December 1, overall poll percentage of 76.9% was witnessed across the State including 84.6% in Jammu division and 17.3% in Kashmir division.

He said in Phase-V which went to polls on November 29, the State witnessed a poll percentage of 71.1%including 33.7% in Kashmir division and 85.2% in Jammu division.

He said in Phase-IV, the state witnessed a poll percentage of71.3%, including 82.4% in Jammu division and 32.3% in Kashmir division. In Phase-III, the State witnessed a poll percentage of 75.2% which includes 55.7% in Kashmir division and 83.0% in Jammu division.

In the Phase-II of Panchayat Polls, overall 71.1% polling was witnessed across the State with 80.4% polling in Jammu division and 52.2% in Kashmir division.

Similarly, in the Phase-I of Panchayat Polls held on 17 November 2018, 74.1% polling was recorded across J&K including 64.5% in Kashmir division and 79.4% in Jammu division.

He said results have been announced for all these Phases by the respective Returning Officers.

CEO said orders have been passed in various complaint cases as well as directions of the Courts and wherever necessary Notifications reappointing the election schedules have been issued. “All such orders/notifications are available at website of CEO J&K,” he said.

Kabra said Basic Minimum Facilities (BMF) have been ensured in all the polling stations across the State for Phase-III.  Photo Voter Slips have been distributed among the voters to inform them of their polling stations.

He said senior government officers have been appointed as General Observers to oversee the smooth, fair and orderly conduct of Panchayat Elections, 2018. Also, Expenditure Observers are keeping a watch on the expenditure by the candidates. In addition, for the poll day, Micro Observers have been placed in polling stations, particularly those considered hypersensitive. Besides, the Zonal and Sector Magistrates too have been deployed.

CEO said Control Rooms have been established in all the districts across the State to respond promptly to any complaints of violation of the Model Code of Conduct as also to disseminate information to the public. Security arrangements have been made including deployment of Central Armed Police Forces (CAPF).

He said the Government has declared holiday on the day of poll in the Panchayat areas going to polls so as to enable the voters to cast their vote. He said special casual leave shall also be granted to the employees who have to go to other areas to exercise their right to franchise. As per standing guidelines, the Central Government offices shall not be closed but the employees who are electors of the poll going wards and desire to exercise their franchise shall be offered reasonable facility to do so.

The Chief Electoral Officer, J&K appealed the voters to come forward and exercise their right to franchise in order to choose their local self-government to address their local needs.

Farooq Abdullah’s hands drenched with blood of Kashmiris: PC

Srinagar, Dec 03 (KNS): Peoples Conference (PC) on Monday said that NC President Farooq Abdullah’s hands are drenched with the blood of thousands of innocent Kashmiris – who had lost their lives due to NC’s opportunistic politics and the party’s insatiable thirst for power at any cost.

In a statement issued to KNS, a spokesman of J&K Peoples Conference said that Farooq Abdullah should introspect as to how the costs of his treachery, rank opportunism and ideological ambiguity have been borne by the people of Kashmir over the past many decades. “While Farooq Abdullah’s utterings can’t be taken seriously as he has an uncanny ability to contradict himself with every passing fortnight, it is pertinent to put the facts on record. The election of 1987, which was rigged to impose Farooq Abdullah on the people of Kashmir, was a collective murder that has spread over three bloody decades and cost us nearly one lakh innocent lives till now. Farooq Abdullah has been allowed to walk away from murder.

Every single Kashmiri will testify as to how Farooq Abdullah’s thirst to become Chief Minister threw the State into the throes of turmoil and suffering. He walked over thousands of dead bodies to again assume power in 1996. That was the second mass murder he committed. There is still no closure to the 1987 rigging. The violence which started after the rigging is yet to end,” the spokesman added.

“Farooq Abdullah might not believe us but he must ask his newfound friend – the PDP about NC’s role in pushing Kashmir’s youth towards militancy. As PDP has repeatedly reminded Farooq Abdullah in the recent past (Including statements from Mehbooba Mufti) – it was he who was responsible for creating the Syed Salahuddins of Kashmir. His newfound allies have – on numerous occasions – said this on the floor of the assembly and this is not far from the truth”, the spokesman said. “Maybe it is time for the PDP also to spell out whether they still believe that 1987 rigged elections were one of the main causes of drift towards violence, which is yet to end.”

The spokesman said that many attempts were made prior to 1987 to bring in the gun into Kashmir but failed. “1987 rigging scripted the conduciveness and the receptiveness for gun in Kashmir. And now they have the audacity to accuse those who were victims of rigging,” the spokesman said, adding that the rigging of 1987 was done to protect the dynastic rule of the Abdullahs at an unimaginable cost of pushing a peaceful heaven like Kashmir into the vortex of violence and the present show of togetherness exhibited by NC and PDP is yet again an attempt to protect the old and the new dynasty.

The spokesman said that Farooq Abdullah’s promises on defending Article 370 in an alliance with the PDP and the Congress were ridiculous. “NC has been an ever-ready accomplice in the erosion of the State’s special status. They have overtly and covertly facilitated every machination and intrigue hatched against the State. The same Congress that he wanted to ally with recently and has allied with on numerous occasions in the past – has written and enacted every single script of erosion of article 370 and disempowerment in the State. As for the PDP — the same NC told us that PDP was an ‘RSS Trojan Horse’ till yesterday and that the PDP was recruited to weaken the State from within. One wonders how things suddenly changed for Farooq Abdullah and how he expects the people to believe that his party’s desperation against an alternative political force is somehow purportedly a valiant fight for the State’s special status?”, the spokesman said.

The spokesman said NC and PDP are good separatists when out of power and corrupt mainstreamers when in power. “As far as this rhetoric about restoration of Autonomy is concerned – NC was never serious about Autonomy and remembers Autonomy in seasonal circles when it is out of power. While in power the party becomes an absolute unionist in its outlook as humanly possible. NC has been a co-architect in the erosion of Article 370. As demanded by Omar Abdullah in the past – let there be white paper on the turmoil in Kashmir. Let there be a Truth and Reconciliation Commission and let us fix responsibility for the pain and suffering our people have endured. Let us tell the people when Article 370 was eroded and who was responsible”, the spokesman said.
The spokesman said Farooq Abdullah’s ridiculous statement that he will ‘expose’ more of our ‘deeds’ at the appropriate time indicates his desperation and anxiety at the rise of Peoples Conference.

“We haven’t even disclosed 2% of his misdeeds, brazen cases of corruption, complicity in injustices against Kashmir and atrocities against its people. The day we decide to do so would be a very ominous day for National Conference and its Twitter Vice President as well – who is stoically lording over estates and wealth of thousands of crores earned on the graves of our people”. JRL Calls for shutdown on Tuesday in poll-boubd areas

Srinagar, Dec 03 : JRL has called for shutdown in areas going to polls in the seventh phase of Panchayat elections on Tuesday.

In a statement, JRL comprising Syed Ali Geelani, Mirwaiz Umar Farooq and Yasin Malik have asked people to observe a complete protest shutdown in Trehgam, Qadirabad, Qaziabad, Naidkhai, Rafiabad, Pattan, Sukhnag, Parnewa, Shadimarg, Kapran, Hermain, Pombay, Larnoo, Breng, Sagam going to polls tomorrow.

They said the “sham” elections were being thrust on the people by the “authoritarian state.”

J&K Bank as PSU : Sopore Fruit Mandi Association hold press conference

Sopore, Dec 03 : The Fruit Mandi Association of Sopore in North Kashmir’s Baramulla district on Monday held a press conference against recent decision of the State Administrative Council (SAC) in declaring Jammu and Kashmir Bank as a Public Sector Undertaking (PSU).

During the press conference which held at Fruit Mandi in which President of Sopore Fruit Mandi Fayaz Ahmad Malik alais Kakaji while seeking the rollback of SAC’s decision of declaring Jammu and Kashmir Bank a PSU, said that we condemn this decision of Government for taking this step which will create problem here in Kashmir especially for poor category people.

He said that Jammu and Kashmir Bank despite being a back bone for people here, government should not touch this as thousands of families will be affected badly.

Meanwhile president expressed apprehensions that this will adversely impact the functioning of Jammu and Kashmir Bank and shake the confidence of its huge clientele.

Others who were present in the press conference including industries President Javeed Ahmed and other senior fruit growers of town were present.

Police bust two militant modules in south kashmir, 10 arrested

Police on Monday claimed to have busted two modules of JeM outfit and arrested 10 of its associates in Tral area of Awantipora and Khrew area of Pampore.

The spokesman said that four persons identified as Younis Nabi Naik, son of Ghulam Nabi Naik, a resident of Pinglish, Fayaz Ahmad Wani, son of Ghulam Mohi-ud-din Wani, a resident of Reshipora, Riyaz Ahmad Ganaie son of Mohammad Ramzan Ganaie resident of Nigeenpora and Bilal Ahmad Rather son of Ghulam Rasool resident of Hafoo Nigeenpora. They were later taken into custody.

Police also busted another militant module in Khrew area of Pampore in which six associates of JeM outfit were arrested. They were identified as Javaid Ahmad Parray son of Mohammad Shaban resident of Bethan Khrew, Yasir Bashir Wani son of Bashir Ahmad Wani resident of Babapora Khrew, Tahir Yousuf Lone son of Mohammad Yousuf Lone resident of Khrew, Rafiq Ahmad Bhat son of Ghulam Ahmad resident of Sharshali Khrew, Javaid Ahmad Khanday son of Ghulam Ahmad Khanday resident of Khrew and Imran Nazir son of Nazir Ahmad Najar resident of Mandakpaul Naimsaab Khrew.

According to a spokesman, a huge quantity of incriminating materials was recovered from the module including gelatine sticks, detonators, materials for making IEDs and grenades.

Mehbooba warns of 2008 like uprising if orders on PRC rules, JK Bank or not immediately withdrawn

Srinagar, Dec 02 (KNS): Peoples Democratic Party (PDP) president and former chief minister Mehbooba Mufti on Sunday warned Governor Administration of 2008 like uprising if it does not withdraw orders on Permanent Resident Certificate (PRC) rules and Jammu and Kashmir Bank.
Talking to Kashmir News Service (KNS), Mehbooba said, “An unwanted order for land transfer was also issued in 2008 and a public uprising across Kashmir forced then government to withdraw the order immediately and this time when Governor has issued similar unwanted orders on Permanent Resident Certificate (PRC) rules and J&K Bank, and I warn Governor’s administration of 2008 like public uprising if it does not withdraw both the orders immediately and forthwith.”
Saying that all the political parties PDP, NC and others are on the same page as far as the rules governing Permanent resident Certificates and Jammu and Kashmir Bank are concerned, Mehbooba expressed his surprise over the Governor’s nonstop tendencies of issuing unwanted controversial orders like Amendment in J&K Municipal act, J&K Bank, PRC rules.
Saying that her party (PDP) particularly the patron late Mufti Mohammad Sayeed had also warned then government over the land transfer for Amarnath Yatra in 2008, Mehbooba told KNS, “Government withdrew the order but it was too late. We along with NC are on the same page as far as the special status of Jammu and Kashmir is concerned and urge the government to immediately withdraw the orders on PRC and J&K Bank or be prepared to face a 2008 like stir. I as chief minister also resisted such moves and during my address to August 15 day parade at Bakhshi stadium Srinagar, I declared that PDP, NC and other likeminded parties are on the same page as far as the special status of Jammu and Kashmir is concerned. We planned to form a government with the support of NC and Congress only to protect special status of the state but Governor foiled this attempt.” (KNS)

Governor’s message on “International Day for Persons with Disabilities”

Jammu, Dec 2 (GNS): Governor Satya Pal Malik has stressed the high importance of observing the “International Day for Persons with Disabilities” to promote a better understanding of disability issues and for mobilizing support to enhance the dignity, rights and well-being of persons with disabilities.

Governor observed that with the recent enactment of the ‘Jammu and Kashmir Rights of Persons with Disabilities Bill, 2018’various matters related to Persons with Disabilities will be dealt with enhanced effectiveness.  He noted that the new law will not only enhance the Rights and Entitlements of Persons with Disabilities but also provide an effective mechanism for ensuring their empowerment and positive and meaningful inclusion into the Society.

Governor urged the public to vigorously strive for establishing an inclusive and equitable environment which specially cares for all persons with disabilities. (GNS)
